other limits). The Software may or may not attempt to enforce said restrictions and the Software's
failure to enforce said restrictions does not constitute a license for you to go beyond said restrictions.

2.8 You agree to obtain any necessary registration/licence key only from Qiagen or an authorised
distributor and to keep said key strictly confidential from all third parties.

3. Termination

3.1 If you fail to comply with the terms and conditions of this licence then without prejudice to any
other rights Qiagen may terminate this licence.

3.2 Within 7 days of termination of this licence, you will furnish to Qiagen a letter attesting to the
destruction of the original and any copies of the Software and the destruction of all copies of any
registration/licence key. You may terminate this licence at any time by furnishing such confirmation.

4. Limited Warranty/Liability

4.1 Qiagen warrants to you only that:

a) If the software is supplied on CD-ROM the CD-ROM is free from defects in materials and
workmanship under normal use for a period of ninety days from the date of purchase. (We will
replace any defective CD-ROM free of charge.)

b) If used properly the Software will conform substantially in accordance with the documentation
supplied with the Software or other specification published by Qiagen for a period of ninety days
from the date of purchase.

4.2 Qiagen's entire liability and your exclusive remedy shall be at Qiagen's option either
compensation to the value of two hundred and fifty US dollars (US$250) or replacement of the
Software that does not meet the limited warranty.

4.3 WITH THE EXCEPTION OF THE WARRANTIES GIVEN IN SECTION 4.1 ABOVE AND TO THE
MAXIMUM EXTENT PERMITTED BY LAW QIAGEN GIVES NO OTHER WARRANTIES IN RESPECT
OF THE SOFTWARE.

4.4 TO THE MAXIMUM EXTENT PERMITTED BY LAW AND UNDER NO CIRCUMSTANCES AND
UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE WILL QIAGEN BE LIABLE TO
YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR
CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION,
