change product specifications provided such changes in specifications do not adversely affect the performance of
products scheduled for future delivery under an existing purchase contract. Buyer’s sole remedy with respect to any
warranty or defect is as stated above.
Production samples of products covered hereunder have been tested and verified to comply with the limits for a
class A digital device, pursuant to Part 15 of the FCC regulations. These limits are designed to provide reasonable
protection against harmful interference when the equipment is operated in a commercial environment. This
equipment generates, uses, and can radiate radio-frequency energy and, if not installed and used strictly in
accordance with the installation and instruction manual, may cause harmful interference to radio communications, or
may be subject to radio frequency interference from other sources. Operation of this equipment in a residential area
is likely to cause harmful interference, in which case users will be required to correct such interference at their own
expense. All costs of installation, including costs associated with avoiding interference of any kind, shall be borne
by the Buyer.
EXCEPT AS SPECIFIED HEREIN, PROXIM MAKES NO OTHER WARRANTIES WITH RESPECT TO
PRODUCTS MANUFACTURED BY PROXIM, AND DISCLAIMS AND EXCLUDES ALL OTHER
WARRANTIES, EXPRESS OR IMPLIED, TO THE EXTENT ALLOWED BY APPLICABLE LAW,
INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
WARRANTIES OF NON-INFRINGEMENT OR WARRANTIES ARISING FROM A COURSE OF DEALING,
USAGE, OR TRADE PRACTICE.
LIMITATION OF LIABILITY
NOTWITHSTANDING ANYTHING ELSE IN THIS WARRANTY, PROXIM SHALL NOT BE LIABLE
UNDER ANY PROVISION OF THIS WARRANTY OR UNDER ANY CONTRACT, NEGLIGENCE, STRICT
LIABILITY, OR OTHER LEGAL OR EQUITABLE THEORY (A) FOR ANY AMOUNTS IN EXCESS OF THE
AGGREGATE AMOUNTS PAID BY BUYER TO PROXIM FOR THE PRODUCT, OR (B) FOR ANY
INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR (C) FOR THE COSTS OF PROCUREMENT OF
SUBSTITUTE PRODUCTS OR SERVICES.
