Software License Agreement
1.
GRANT OF LICENSE
. This license agreement permits you to install the enclosed Datacom Textron
SOFTWARE PRODUCT on any computer used in conjunction with your Datacom Textron HARDWARE
PRODUCT.
2.
COPYRIGHT
. The enclosed SOFTWARE PRODUCT is owned by Datacom Textron and is protected
by United States copyright laws and international treaty provisions.
3.
OTHER RESTRICTIONS
. You hereby agree not to rent or lease the SOFTWARE PRODUCT
without the prior written authorization of Datacom Textron. You may transfer the SOFTWARE
PRODUCT and license herein granted to another party (Transferee) if the Transferee agrees to accept the
terms and conditions of this Agreement, and provided you retain no copies. You may not reverse engineer,
decompile, or assemble the SOFTWARE PRODUCT.
LIMITED WARRANTY
Datacom Textron warrants this Software Product to operate substantially in accordance with the
accompanying documentation for a period of 90 days from the date of original purchase. By opening the
sealed package, you agree that the only remedy available will be replacement of defective CD or the
correction of the defects submitted in writing as defined above. No warranty, whether expressed or implied
shall apply following the expiration of the 90 day period from the date of original purchase.
THE WARRANTIES SET FORTH ABOVE ARE IN LIEU OF ANY OTHER WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES
OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT
WILL DATACOM TEXTRON BE LIABLE FOR DAMAGES, INCLUDING ANY LOSS OF
PROFITS, LOST SAVINGS, OR ANY OTHER INCIDENTAL OR CONSEQUENTIAL
DAMAGES ARISING OUT OF THE USE OF, OR INABILITY TO USE THE PROGRAM, EVEN
IF DATACOM TEXTRON OR ITS AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES.
This limited warranty gives the Purchaser specific legal rights, and the Purchaser may have other rights
which may vary by state/jurisdiction. Some states/jurisdictions do not allow limitations on how long an
implied warranty lasts, or do not allow the exclusion of limitation or limitation of incidental or
consequential damages. Some of the above limitations and exclusions may not apply to you.
