PE Corporation (NY), through its Applied Biosystems Group (“Applied Biosystems”)
warrants to the customer that, for the Warranty Period (“the Warranty Period is as
stated by Applied Biosystems in the accompanying documentation and begins on the
date of shipment to the customer”), the GeneAmp
® PCR Instrument System
purchased by the customer (“the Instrument”) will be free from defects in material and
workmanship, and will perform in accordance with the specifications set out in the
Instrument’s User’s Manual. If the Instrument fails to perform in accordance with the
specifications during the Warranty Period, Applied Biosystems will replace or repair
the Instrument, at a site designated by Applied Biosystems, at no charge to the
customer.
The Warranty does not extend to any Instrument or part thereof that has been the
subject of misuse, neglect or accident, that has been modified or repaired by any party
other than Applied Biosystems or its designees, or that has been used in a manner
not in accordance with the instructions contained in the Instrument User’s Manual.
Applied Biosystems’s obligation under this Warranty is limited to repairs or
replacements that Applied Biosystems deems necessary to correct covered defects or
failures of which Applied Biosystems is notified prior to expiration of the Warranty
Period. All repairs and replacements under this Warranty shall be performed by
Applied Biosystems’s service engineers or designees.
No agent, employee, or representative of Applied Biosystems has any authority to
bind Applied Biosystems to any affirmation, representation, or warranty concerning
the Instrument that is not contained in the printed product literature or this Warranty
Statement. Any such affirmation, representation, or warranty made by any agent,
employee, or representative of Applied Biosystems shall not be binding on Applied
Biosystems.
Applied Biosystems shall not be liable for any incidental, special, or consequential
loss, damage or expense directly or indirectly arising from the purchase or use of the
Instrument. Applied Biosystems makes no warranty whatsoever with regard to
products or parts furnished by third parties; such products or parts will be subject to
the warranties, if any, of their respective manufacturers.
This Warranty is limited to the original customer and is not transferable.
THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY AS TO THE
INSTRUMENT AND IS IN LIEU OF ANY OTHER EXPRESS OR IMPLIED
WARRANTIES, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND OF
ANY OTHER OBLIGATION ON THE PART OF APPLIED BIOSYSTEMS.
