4. Guarantee

(1) Oki Data and its licensers do not guarantee anything regarding the software, including the following. That

using the software will enable the customer to obtain the desired performance or results.

That the software is free from defects.

That the software does not violate the rights of third parties. That

the software is fit for a specific purpose.

(2) The software may be modified or changed without notice.

5. Limited Liability

Oki Data and its licensers will not be held responsible for any direct, indirect, or derivative damages or

losses caused by the software, even if Oki Data was aware of the possible of such damages occurring,

even if the claim for those damages is based on an illegal act (including, but not limited to negligence),

or based on any other legal grounds. Furthermore, Oki Data and its licensers will also not be held

responsible for any claims made by third parties caused by the software or related to the software.

6. Applicable Law

The license agreement for the software is based on Japanese law, including the formation of this

agreement.

7. Validity of This Agreement

If part of this agreement is deemed invalid and not legally binding, this will not affect the other parts of

this agreement, and those other parts will remain valid and legally binding.

8. Export Control

The software may not be exported to countries prohibited by the export control laws of Japan and the

United States or other related laws and regulations, and may also not be used in a way that is prohibited

by any law or regulation. The customer agrees to not export or re-export the software or products

created from the software without obtaining permission from the government of the United States and

Japan. If the customer violates this clause, this agreement is terminated automatically.
