You can protect your network from DMCA liability for customer file sharing and comply with
law enforcement monitoring requests under CALEA by maintaining long-term logs of
subscriber activity. The new Subscriber Connection Logging feature on the Controller makes
this possible.
Understanding` the Digital Millennium Copyright Act (DMCA):
Under the DMCA, individuals and companies are responsible for damages caused by the
sharing of copyrighted works, such as movies, music, TV shows, and anything else, over their
networks. The good news is that the law provides a Safe Harbor against liability for ISPs and
other service providers, provided they can show that is was an end user violating the copyright
and that the material is no longer available. This is why people, maybe someone you know
even, get threatening letters from their ISP when someone is sharing files on their network.
The large ISPs are bound by these same Safe Harbor rules. The bad news is that in the area
of public access, it may be difficult to prove that it is not an employee of the network provider
sharing the file, or that the file is no longer available. Without proof of exactly who did what
when on the network, you may not be covered by DMCA Safe Harbor, and therefore liable for
whatever damages the MPAA, RIAA, or other copyright holder feels they have suffered from
file sharing on your network. The Copyright holder may also demand the identity of the
violator. Legally the European Union is more or less the same situation under the EUCD
regulations.
