Agreement For Online Security Services
The following terms and conditions apply should you wish to be supplied with the Monitoring Services.
Definitions
Where used in this agreement:
"We", "Us", and "Our" refers to Valet Monitoring Pty Ltd (ABN 62007539577), its successors and assigns.
"You" and "Your" refers to you the client, your successors and permitted assigns.
"Monitoring Services" refers to the services described below under the heading Monitoring Services Definition.
“Emergency Services” refers to the Police, Ambulance, Fire Brigade or other public authority.
"Guard Services" means persons providing the attendance at Your premises by a guard, to observe whether Your
premises appear secure, by means of visual external check at street level of accessible areas immediately adjacent to the
area in alarm.
Registration
As part of the registration process You must provide Us with certain information, which You must ensure is accurate in all
respects, and You agree to keep that information updated so that Our records are current, complete and accurate. Should
that information change, You are responsible for ensuring that the information is updated immediately.
If You accept this agreement, You are requesting Us to supply Monitoring Services by clicking "I accept, please supply the
Services".
You must keep Your login and password details confidential. You are responsible for the security of this information and
should not disclose it to any person unless it is absolutely necessary to do so.
We agree to keep all information You provide to Us confidential and secure and We will not disclose this information to
any other person unless We have Your consent to do so, or it is reasonable for Us to assume You would have agreed to
Us disclosing this information had We had the opportunity to obtain Your consent, or We are required to do so by law. You
expressly consent to Us providing this information to Our Monitoring Services provider. We will comply with all relevant
privacy laws.
Monitoring Services Definition
We, or Our Monitoring Services provider, will monitor Your signals from Your systems in accordance with the
configurations You have or will set through this website. You are solely responsible for setting these configurations.
Notification of any signal events will occur to You, Your contacts, Emergency Services, or Guard Services subject to Your
configuration You have set or will set through this website. Any notification will occur by means of either telephone, SMS,
MMS, or email subject to the configuration You have set or will set through this website
In the event You or Your contacts can or can not be notified then, subject to the configuration You have set on-line,
Emergency Services and Guard Services may or may not be notified, and You must pay Us for any additional charges
incurred should these services be notified. You indemnify both Us and Our Monitoring Services provider in relation to
these costs.
In the event that Your premises are found to have been violated, and You are still unable to be notified, You authorise Us
to mount a static guard, if considered necessary, until the next regular working day, and You must pay Us the additional
charges incurred should these services be necessary.
Price and Payment for Monitoring Services
You agree to pay to Us the fees for the provision of the Monitoring Services.
These fees are set out in the customer report provided to You by Us and/or as set out on this website. We may vary these
fees from time to time by notice to You, including via this website. You agree however, to any increase in these fees We
may make at any time to reflect increases in Our telecommunications carrier fees, and annually to reflect increases in the
Consumer Price Index.
Except in the event of manifest error, You are responsible for all fees incurred in relation to Your login and password, and
the Monitoring Services relating to same, irrespective of whether You are the person using that login or password.
We will forward a tax invoice to You for Our fees in arrears each month and We will direct debit Your specified account.
Should You fail to pay the fees due within seven (7) days of the due date, We may, at Our option terminate this agreement
and the supply of the Monitoring Services forthwith by notice in writing to You. Without limiting this right, We may charge
interest on any outstanding payments at a rate of 3% per annum above the rate quoted on the day of demand by Our bank
on unsecured overdraft accommodation of $100,000.00.
You must pay for attendance by Guards responding to an actionable event, which will be charged at Our then generally
applicable rate of charge unless otherwise agreed by Us in writing.
You must also pay all monies payable to Emergency Services in relation to any attendance at the Premises and shall
reimburse any such amounts paid by Us on Your behalf.
