Warranty conditions:
The following warranty of Firebird International AG applies on all gliders purchased after the
01.01.2005. Firebird gives a warranty on the airworthyness of the gliders for 5 years or 500 flight
hours (whatever is reached first is operative).
1. Extent of the warranty
The guarantee begins with the date of the purchase. All gliders that are verifiably not airworthy
anymore because of manufacturing or material defect are repaired or replaced. Reparation or
replacement do not prolong the guarantee. Replaced parts become property of Firebird.
2. conditions
Conditions of warranty use:
a) The warranty card has to be filled out correctly and completely and sent within 7 days after the date
of purchase back to Firebird ( date of the postmark decides).
b) The buyer takes notes of his flights - particularly his flight time - in a flight book that is updated
regularly and countersigned by another pilot or an equally qualified person.
c) The glider is in accordance with the information in the manual treated correctly, especially cleaned,
dried, packed and stored properly.
d) The glider has to be checked at the latest after 2 years or 200 flight hours - the first reached counts
- by Firebird (or a place authorized by Fierbird) at the buyers expense.
e) All for the buyer valid legal provisions to preserve the glider airworthy must be abided.
3. Warranty use
In case the warranty has to be used the client has to send the glider with a copy of the proof of
purchase and a copy of the flight book at his own risk and expense to Firebird from where it will be
sent back freight forward.
4. Validity
This warranty is valid only for paragliders used for recreation purposes. Paragliders that are used in
schools, for professional purposes or in applications with extremly high load (like for example
competition, acrobatic flight, etc.) are excepted from this warranty. This warranty is also not valid for:
a) Bleaching of the colours of the cloth,
b) damage caused by solvents resp. petrol, sea water, chemicals,
c) all damage caused by accident ( including take off, landing and during the flight),
d) damage that the buyer has caused,
e) damage caused by emergency situations,
f) damaged caused by incorect usage,
g) paragliders with removed, destroyed or modified serial number,
h) damage caused by foreign manipulation, not authorized modification or misuse,
i) damage caused by act of God.
j) this warranty is only valid for the buyer and is not transferable.
5. Exclusion of further liability
The client has the rights in this warranty additionaly to the legal warranty rights. The right of the client
is in any case first of all reparation and replacement. Îf reparation and replacement fail repeatedly the
client can enforce change or reduction. Furthermore Firebird is not liable in any case, not for direct,
mediate, side or consequential damage, indifferently if they are based on contracts or other legal
claims.
6. Conclusion
Swiss law is applied. UN-sales right excluded. Area of jurisdiction is at the head office of Firebird.
