2.3.1 - WARRANTY
1) This Conventional Warranty is provided free of charge by the
manufacturer through its network of Technical Assistance
Centres located throughout Italy and concerns new UNICAL
products installed in Italy.
It neither excludes nor restricts the rights arising from Direc-
tive 99/44/EC and its implementing decree in Italy Legislative
Decree No. 24/2002 as amended and supplemented.
The Directive in question envisages that in the event of a
lack of conformity of the product, the consumer has a right of
recourse against the final seller to have the defects rectified
free of charge within a period of 24 months from delivery/
purchase.
These terms and conditions of the Conventional Warranty
(to be understood as supplemented, in the cases foreseen
for extension, by what is stated in the attached ANNEX TO
THE INSTALLATION, USE AND MAINTENANCE MANUAL:
EXTENSION OF WARRANTY) are the only ones offered by
the supplier and may not be replaced or modified in any way
by any other statements or promises made by anyone.
2) The manufacturer guarantees that the equipment is free from
defects, in proper working order, suitable for its intended use,
and conforms to current quality standards.
The manufacturer undertakes to eliminate free of charge,
by repair or replacement, any manufacturing defects in the
equipment or its component parts.
Replacement or repair of the entire appliance or a compo-
nent part thereof does not extend the warranty period, which
remains unchanged.
3) This Conventional Warranty starts from the date on which
the appliance is first switched on. For products in which
commissioning is not present and/or provided for, the
conventional warranty starts from the date of purchase
of the goods by the end user, documented (Art. 4).
If commissioned more than 2 years after the date of man-
ufacture as shown on the serial number, the manufacturer
reserves the unquestionable right to check the condition and
functionality of the boiler before issuing the warranty.
The warranty lasts 24 months, subject to the additions indi-
cated on the front of this form.
For VAT-registered persons, the duration of the warranty is
12 months.
4) The Conventional Warranty applies on condition that:
- the user is in possession of a valid tax document proving
the purchase;
- the commissioning of the device and any subsequent
repair work is carried out by personnel authorised by the
manufacturer;
- the user did not purchase the product online. In this case,
the product will be covered by the vendor's warranty in
accordance with the law.
Excluded from this Conventional Warranty are all defects
resulting from the following causes:
- incorrect installation or non-compliance of the system with
the relevant regulations in force, and with the instructions
given in the "Installation, Use and Maintenance Manual"
supplied with the appliance;
- tampering and interventions in general by technical person-
nel not authorised by the manufacturer;
- failure to perform or incorrect performance of routine peri-
odic maintenance work as required by current regulations
and the ''Installation, Use and Maintenance Manual'';
- wilful or culpable conduct attributable to a vendor or other
person unrelated to the manufacturer during transport,
handling, storage, assembly, installation and adjustment
of the appliance;
- use of the appliance for purposes other than those for
which it is intended or in a manner other than indicated in
the ''Installation, Use and Maintenance Manual'';
- use of non-original spare parts, components and accesso-
ries;
- inefficiency of the chimneys, flues or parts of the system
on which the appliance depends;
- electrical or hydraulic installations that do not comply with
current standards;
- corrosion, scaling or cracks caused by stray currents, con-
densation, aggressive or acidic water, improperly performed
descaling treatments, lack of water, sludge or lime deposits;
- fuels with different characteristics from those indicated in
the ''Installation, Use and Maintenance Manual'';
- force majeure events such as lightning, fire, frost, floods,
vandalism;
- transport damage not carried out by the manufacturer;
- all parts subject to normal wear and tear in use such as:
gaskets, knobs, glass, vermiculite/refractory parts, brazier,
flame diverter, buffer batteries, fuses, turbulators, com -
bustion chamber paint, self-cleaning systems inside the
combustion chamber,
- all aesthetic parts such as: metal cladding, ceramic, majol-
ica, stone;
- colour variations, cracks and differences in colouring of
the majolica or ceramic parts do not constitute grounds for
complaint as they represent the naturalness of the material
itself;
- interventions to adjust or calibrate the product in relation
to: pellet quality, type of chimney or hydraulic installation,
setting parameters: clock, chronothermostat, operating
mode, etc..;
- adjustment work on the hydraulic system: pump unblocking,
expansion vessel pressure adjustment, air venting, etc..;
- verification of the chimney installation: draught tests, com -
bustion analysis, operation checks, etc..;
- software upgrades on the circuit board if not authorised by
the manufacturer;
- activities and operations to access the product: dismantling
walls, setting up scaffolding, emptying hydraulic system,
etc..;
- work to adapt, install and adjust any optional accessories;
Any technical assistance required to rectify defects attributa-
ble to one of the causes of exclusion mentioned above may
be agreed upon separately from this Warranty.
5. For any possible dispute, the competent court shall be exclu-
sively that of Mantua.
