You agree that you shall not, by way of example and not limitation:
(a) copy the Documentation;
(b) copy the Software, except as permitted in Section 3;
(c) create derivative works, modify, alter, transform, translate, tamper, or adapt the Software or Documentation, or
merge the Software into another program;
(d) reverse engineer, disassemble, decompile, or make any attempt to discover or gain access to the source code of
the Software;
(e) place the Software onto a processor or server so that it is accessible to any third party, or any public network,
such as the Internet;
(f) sublicense, rent, lease, or lend any portion of the Software or Documentation; and
(g) remove, obliterate, or cancel from view any patent, copyright, trademark, or confidentiality
notice or legend appearing in connection with the Software, its media, the Documentation or
output generated by the Software.
You agree to transfer to McQ all intellectual property and ownership rights for any version
created from the unauthorized modification or adaptation of this Software, including versions
created from the translation and/or reverse engineering of the Software
5. TRANSFERS
As noted above, you may not sublicense the Software. You may, however, transfer or assign ALL of your rights to
use the Software and Documentation to one (and only one) other person or legal entity, provided that they agree to
all the terms and conditions of this Agreement, and that you transfer to such person a copy of this Agreement, the
Software and Documentation (including any backup copy made under Section 3), and all updates or prior versions.
If you so transfer the Software, then you agree to retain no copies of the Software or
Documentation, including copies stored on any computer or media.
6. LIMITED WARRANTY
McQ warrants that for a period of one (1) year after delivery of this copy of the Software to you the physical media,
if any, on which your copy of the Software is distributed will be free from defects in materials and workmanship
under normal use, and during that one (1) year the Software will perform in substantial accordance with the
Documentation. Notwithstanding the foregoing, this Agreement makes no representation or warranty concerning
any equipment or any other deliverable or performance of McQ. The foregoing express, limited warranty is in lieu
of all other warranties.
THE SOFTWARE AND SUPPORTING DOCUMENTATION IS PROVIDED "AS IS" WITHOUT ANY OTHER
WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. McQ DISCLAIMS ANY AND ALL
OTHER WARRANTIES, REPRESENTATIONS, OR CONDITIONS, EXPRESS, IMPLIED, OR STATUTORY,
RELATING TO THE SOFTWARE AND DOCUMENTATION, INCLUDING ANY IMPLIED WARRANTY OF
TITLE, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR A
PARTICULAR PURPOSE. McQ DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THIS
SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE
WILL BE UNINTERRUPTED OR ERROR FREE. IN ADDITION, McQ DISCLAIMS ANY AND ALL
WARRANTIES OR REPRESENTATIONS TO ANY PERSON OTHER THAN YOU WITH RESPECT TO THE
SOFTWARE.
No employee, agent, dealer, or distributor of McQ is authorized to modify this limited warranty,
or to make any additional warranties.
