ENERGYTUBE ® MODULATING WARRANTY
ROBERTS-GORDON WILL PAY FOR:
Within 36 months from date of p u rchase by b u yer or 42
months from date of shipment by Roberts-Gordon LLC
(
w hiche v er occ u rs first), replacement parts w ill be pro v ided
free of charge for any part of the prod u ct w hich fails d u e to
a man u fact u ring or material defect.
Roberts-Gordon LLC w ill req u ire the part in q u estion to be
ret u rned to the factory. Roberts-Gordon LLC w ill, at its sole
discretion, repair or replace after determining the nat u re of
the defect and disposition of part in q u estion.

ROBERTS-GORDON WILL NOT PAY FOR:
Ser v ice trips, ser v ice calls and labor charges.
Shipment of replacement parts.
Claims
w here the total price of the goods ha v e not
been paid.
Damage d
u e to:
• Improper installation, operation or maintenance.
• Mis u se, ab u se, neglect, or modification of the
ROBERTS GORDON ® ENERGYTUBE ® MODULATING
in any w ay.
• Use of the ROBERTS GORDON ® ENERGYTUBE ®
MODULATING for other than its intended
p
u rpose.
• Incorrect gas or electrical s u pply, accident, fire, floods,
acts of God, w ar, terrorism, or other cas u alty.
• Improper ser v ice, u se of replacement parts or acces-
sories not specified by Roberts-Gordon.
• Fail u re to install or maintain the ROBERTS GORDON ®
ENERGYTUBE
®
MODULATING as directed in the
Installation, Operation and Ser v ice man u al.
• Relocation of the ROBERTS GORDON
®
ENERGY-
TUBE ® MODULATING after initial installation
• The u se of the ROBERTS GORDON ® ENERGYTUBE ®
MODULATING in a corrosi v e atmosphere containing
contaminants.
• The u se of the ROBERTS GORDON
®
ENERGYTUBE
®
MODULATING in the v icinity of a comb u stible or explo-
si v e material.
• Any defect in the ROBERTS GORDON ® ENERGY-
TUBE ® MODULATING arising from a dra w ing, design,
or specification s u pplied by or on behalf of the con-
s u mer.
• Damage inc u rred d u ring shipment. Claim m u st be filed
w ith carrier.
WARRANTY IS VOID IF:
The ROBERTS GORDON ® ENERGYTUBE ®
MODULATING is not installed by an electrician q u alified in
the installation and ser v ice of gas fired heating eq u ipment.
Yo u cannot pro v e original p u rchase date and req u ired
ann u al maintenance history.
The data plate and/or serial n u mber are remo v ed,
defaced, modified or altered in any w ay.
The o w nership of the ROBERTS GORDON
®
ENERGYTUBE
®
MODULATING is mo v ed or transferred.
This w arranty is nontransferable.
Roberts-Gordon LLC is not permitted to inspect the
damaged controller and/or component parts.

remedy, under this warranty or any implied warranty

g the implied warranties of merchantability
and fitness for a particular purpose) is limited to

g replacement parts durin g the term of this
warranty. Some j u risdictions do not allo w limitations on
ho w long an implied w arranty lasts, so this limitation may
not apply to yo u . There are no rights, w arranties or
conditions, expressed or implied, stat u tory or other w ise,
other than those contained in this w arranty.
Roberts-Gordon LLC shall in no event be responsible
for incidental or conse
q uential dama g es or incur
liability for dama g es in excess of the amount paid by
you for the ROBERTS GORDON ® ENERGYTUBE ®
MODULATING. Some j u risdictions do not allo w the
excl u sion or limitation of incidental or conseq u ential
damages, so this limitation or excl u sion may not apply to
yo u . This w arranty gi v es yo u specific legal rights, and yo u
may also ha v e other rights w hich v ary from j u risdiction to
j u risdiction.
Roberts-Gordon LLC shall not be responsible for fail u re to
perform u nder the terms of this w arranty if ca u sed by
circ u mstances o u t of its control, incl u ding b u t not limited to
w ar, fire, flood, strike, go v ernment or co u rt orders, acts of
God, terrorism, u na v ailability of s u pplies, parts or po w er.
No person is a u thorized to ass u me for Roberts-Gordon
LLC any other w arranty, obligation or liability.
LIMITATIONS ON AUTHORITY OF
REPRESENTATIVES:
No representati v e of Roberts-Gordon LLC, other than an
Exec u ti v e Officer, has a u thority to change or extend these
pro v isions. Changes or extensions shall be binding only if
confirmed in w riting by Roberts-Gordon LLC's d u ly
a u thorized Exec u ti v e Officer.
