WARRANTY
21.1.
Verification after delivery
According to the General Terms and conditions of Sale, the buyer undertakes to return the
sailing boat, within 3 months after delivery and after effective navigation for at least 15 days,
to one of the Garcia Yachting bases (Cherbourg / La Grande Motte) for verification.
If it is impossible for the buyer to meet this commitment, Garcia Yachting may, by
appointment made at least forty five days in advance, send one of its technicians to the boat in
order to carry out this verification. The costs incurred due to this exceptional procedure will be
charged solely to the buyer, in respect of both time spent and all travel expenses,
accommodation and other costs arising on this occasion. The planned location for this meeting
must be approved by Garcia Yachting.
21.2.
Contractual warranty
Without prejudice to the legal warranty detailed in the appendix of the General Terms and
Conditions of Sale, Garcia Yachting guarantees the goods supplied to the buyer against all
manufacturing defects for a period of 12 months from the date of delivery.
The warranty is expressly limited, as the seller chooses, to refurbishment or replacement of
parts recognized as defective by the seller, to the exclusion of all costs such as the costs of
handling operations, transport, parking and conveying, and compensation of any sort.
Any work required within the scope of this warranty must be performed by the seller or by a
company of their choice, according to their instruction alone.
The warranty does not cover damage resulting from an accident, a failure in piloting,
maintenance or normal wear, failure to observe the maintenance recommendations in the
documentation supplied with the boat or good trade practices, or incorrect use, especially
negligent, imprudent, improper or abnormal use, participation in competitions, or negligence in
terms of failure to implement the required protective measures, or if the equipment has been
altered, modified or repaired outside shipyard without the prior written authorization of Garcia
Yachting. The same will apply in the event of failure to adhere to the rules and precautions
mentioned in the owner’s manual.
The warranty specifically excludes the deterioration or damage listed below, together with its
consequences: normal wear, cracks or crazing in the gel-coat, blister under the paint, dents in
the aluminium plating.
The contractual warranty does not cover equipment or accessories not covered by a
contractual manufacturer’s warranty or which have been supplied by the buyer, even if these
have been fitted with the seller.
In respect of equipment and accessories displaying the mark of another supplier, the warranty
is limited to the warranty offered by that supplier.
Any event that damages the structure of the boat and is not the result of a manufacturing
defect covered under warranty, whether or not it has given rise to a repair, entails cancellation
of the warranty, immediately and without prejudice.
The warranty does not apply to incidents resulting from fortuitous circumstances or acts of
God.
The contractual warranty will not be issued in the event of non-compliance with the post-
delivery verification specified in article VIII of the General Terms and Conditions of Sale.
