A RRANTY
Limited Warranty
SOFTWARE:
SMC warrants that t he s oft ware programs licens ed from it wi ll perform
in substantial conformance t o t he program specificat ions for a period of ninety (90)
days from the date of purchase from SMC or its Authorized Resell er. SMC warrants
the magnetic medi a cont aining soft ware against fail ure during the w arranty period.
No updates are provided. SMCís s ole obligation hereunder shall be (at SMC’s
dis cretion) to refund the purchase price paid by Customer for any defective
software products or to replace any defective media w ith software which
substantially conforms to SMC’s applicabl e published specifications . Customer
assumes respons ibilit y for the select ion of the appropriate applications program
and associ at ed reference materials. SMC makes no warranty that its soft ware
products wi ll work in combinati on wit h any hardware or applications softw are
products provided by t hird parties , that the operat ion of the software products will
be unint errupted or error free, or that all defect s in t he software products will be
corrected. F or any third party products lis ted in the SMC softw are product
documentation or specifications as being compatibl e, SMC will make reasonable
efforts to prove compatibi lity, except where the non-compat ibilit y is caused by a
ìbugî or defect in the third partyís product .
STANDARD WARRANTY SERVICE:
Standard w arranty service for hardware
products may be obtained by delivering t he defect ive product, accompanied by a
copy of the dated proof of purchase, to SMC’s Service Center or t o an A uthorized
SMC Service Center during the applicable w arranty period. Standard warrant y
service for s oft ware products may be obtained by telephoning SMC’s Service Center
or an A uthorized SMC Service Center, wi thin the warranty period. Products returned
to SMC’s Service Center must be pre-authorized by SMC w ith a Return Material
Aut horization (RMA) number marked on t he outside of the package, and s ent
prepaid, ins ured, and packaged appropriat ely for s afe s hipment. The repaired or
replaced item wi ll be shipped t o Customer, at SMC’s expense, not later than thirty
(30) days aft er receipt by SMC.
WARRANTIES EXCLUSIVE:
IF AN SMC PRODUCT DOES NOT OPERATE AS
WARRANTED ABOV E, CUSTOMERíS SOLE REMEDY SHALL BE REPAIR,
REPLACEMENT OR REFUND O F THE PURCHASE PRICE PAID, AT SMC’S O PTIO N.
THE FO REGOING WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN
LIEU OF ALL OTHER WARRA NTIES OR CONDITIONS, EXPRESS OR IMPLIED,
EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY O R OTHERWISE,
INCLUDING WARRANTIES O R CONDITIO NS OF MERCHANTABILITY A ND
FITNESS F OR A PA RTICULAR PURPO SE. SMC NEITHER ASSUMES NOR
AUTHORIZES ANY OTHER PERSON TO A SSUME FO R IT ANY OTHER LIABILITY
IN CO NNECTIO N WITH THE SALE, INSTALLATION, MAINTENANCE OR USE OF
ITS PRO DUCTS.
SMC SHALL NOT BE LIABLE UNDER THIS WARRA NTY IF ITS TESTING AND
EXAMINATION DISCLO SE THE ALLEGED DEFECT IN THE PRODUCT DOES NO T
EXIST OR WAS CAUSED BY CUSTOMERíS OR A NY THIRD PERSON’S MISUSE,
NEGLECT, IMPROPER INSTALLATION O R TESTING, UNAUTHORIZED ATTEMPTS
TO REPAIR, OR A NY OTHER CA USE BEYOND THE RA NGE OF THE INTENDED
