Overview
The US and Canadian authorities have developed
emissions standards and safety standards for motor
vehicles, new engines and/or new vehicles and new
accessories taking into account the Clean Air Act, the
Noise Control Act and the National Traffic and Motor
Vehicle Safety Act in the USA and the Motor Vehicle
Safety Act in Canada. These laws apply to the origi-
nal equipment manufacturers of the Mercedes-Benz
Metris, dealers, upfitters and other parties involved in
the manufacture and marketing of new motor vehicles
and new accessories.
Completed Metris vehicles "as delivered" have been
proven to fulfill the aforementioned applicable stan-
dards. Conformity markings on Metris vehicles and
engines indicate the status of initial conformity on the
date of manufacture by Daimler AG (DAG).
Upfitters and dealers, who perform modifications which
may affect the final certification of the engine, the
vehicle or the equipment, take over sole responsibility
for the vehicle.
Upfitters must obtain legal advice regarding the certifi-
cation of the vehicle.
Upfitters are responsible for ensuring that modifica-
tions of this kind do not impair the safety of the vehicle.
For further information on the applicable exhaust emis-
sion and noise standards of the USA and California,
please contact the Environmental Protection Agency
(EPA) and the California Air Resources Board (CARB).
For further information on US vehicle safety standards,
please contact the National Highway Traffic Safety
Administration (NHTSA). Information on the Canadian
standards can be obtained from the Canadian environ-
mental and transport authorities (Transport Canada).
Upon completion of a modified vehicle, the upfitter is
legally obliged to prove that the vehicle continues to
fulfill all applicable safety standards and guidelines for
motor vehicles of the USA and Canada (USA: Title 49 of
the Code of Federal Regulations S567.7, Clean Air Act
section 203(a) and under the provisions of EPA-CFR,
part 86 section 86.09911; Emissions standards for
1999 and later model year heavy-duty diesel engines
and vehicles). Furthermore, the modified vehicle must
comply with all emissions regulations of the USA,
Canada and/or California. In the USA, the sale of a new
vehicle which does not comply with the regulations
incurs a fine of up to US$25,000 (USA) or US$5000/
US$1000 per vehicle (California) which does not com-
ply with the emissions regulations/safety specifica-
tions. In addition, a recall and other sanctions may be
ordered.
The upfitter is obliged to certify the modified vehicle in
accordance with Title 49 C.F.R. §§567.5 - 567.7 in the
USA and in accordance with Section 9 of the Canadian
Motor Vehicle Safety Regulations in Canada.
Daimler AG will not provide any opinion on the confor-
mity of a modified vehicle with the safety standards
for motor vehicles in the USA or Canada where its
conformity could be affected by vehicle modifications.
The upfitter is responsible for proving that the vehicle
corresponds to all standards covering the vehicle mod-
ification.
