The Software Product can be used to measure acceleration and other aspects of motion that are associated with the
operation of motor vehicles or other objects both within and outside the usual range of performance. You and
anyone else using the Software product bear the entire responsibility of the safety of your operations and compliance
with all applicable law. Under no circumstances will Hamilton Performance Electronics be liable for any injury,
loss, damage, casualty, or claim arising out of any use of the Software Product. Further, you will indemnify, defend,
and hold harmless Hamilton Performance Electronics and its equityholders, managers, officers, employees, and
agents from and against any and all third -party damages, losses, claims, or suits (including any costs and attorneys’
fees) arising out of, or related to, your use of the Software Product.
The Software Product is not designed for, and you must not use it in, any application in which property damage,
bodily injury, or death might result if the Software Product fails to function properly. Without limiting the
foregoing, you should not use the Software Product for applications involving provision of medical services,
military operations, police, fire, or ambulance operations, or the operation of aircraft.
