4.
WARRANTY
Producer provides warranty for the products manufactured or delivered by
Producer. The warranty is based on Warranty Terms, the General Conditions
of NL92 in Scandinavia and the General Conditions ORGALIME S92 outside
Scandinavia. In case of a conflict between these terms and conditions, the
Warranty Terms shall prevail.
The warranty period granted by the Manufacturer is 18 months from the
dispatch of the product from the Manufacturer's site but, however, no longer
than 12 months from the date of commissioning, unless otherwise stated. If
the latter warranty period is applied, the customer is obliged to prove the date
of commissioning.
The warranty covers the defects of the Products delivered by the
Manufacturer only if the defects can be proven to be based on material
weakness, poor workmanship, poor design, or result from manufacturing
defects, providing that the warranty period set forth above has not expired.
The Warranty never covers or compensates any consequential or other
indirect damages or losses such as but not limited to loss of production, loss
of profit, malfunctions or incidental damages of system used with the
Products.
In no event and under no circumstances shall the manufacturer be liable for
damages and failures due to misuse, abuse, improper installation, or
abnormal conditions of ambient, or failures due to operation above rated
capacities. The manufacturer carries no responsibility for damages due to
transportation, or unpacking.
Repair measures, performed by the Manufacturer, or by an Authorized
Service, shall be covered by Warranty Terms for a time of the remaining
product warranty period or for a period of 3 months, whichever is longer. The
warranty period exceeding the original product warranty covers the part of the
device subject to repair measures. This warranty period of 3 months for
performed repair measures shall be solely granted either by the
Manufacturer or an Authorized Service, whichever carries the responsibility
for the repair.
4.1 Service policy
The service for the units under manufacturer provided warranty is based on
procedure, where defective units on the field, in power range up to 90kW
(mechanical size M7) will be replaced with equivalent units. Units, rated above
90kW will be repaired on site by Producer authorised service technician with
