9 Warranty and after sale services
WARRANTY COVER
ABTYS shall provide the purchaser of this product (TRITON™) with the services presented below.
ABTYS, the manufacturer warrants TRITON™ against any defects in materials and workmanship for a
period of 2 years from the date of first purchase:
•
Alarm system & siren-2 year parts and labor; and any consumables (e.g. batteries,
dehydrating sachets, magnets, etc.) included in the original TRITON™ - 90 days free
replacement.
Warranty replacement or repair will not extend the 2 years period of warranty.
If TRITON™ proves to malfunction due to a defect in materials or workmanship during the
guarantee period, ABTYS shall either replace or repair the device (during the immobilization
period be sure to increase active monitoring of your pool). IN NO EVENT OR CIRCUMSTANCES
shall ABTYS be held responsible for any other costs, charges, expenses, losses or damages
(indirect or otherwise), of any kind whatsoever.
ABTYS reserves the right to replace the repairable parts with new or as-new parts.
As a pre-condition to any warranty, you must: (i) install the alarm system in compliance with the
applicable product documentation; (ii) successfully perform any installation tests required in the
applicable product documentation; (iii) conduct regular maintenance and tests of the alarm system as
set forth in the applicable product documentation.
This warranty constitutes ABTYS’s entire responsibility with regard to the products and services
supplied pursuant to this guarantee
This warranty shall be null and void in the event of any transfer of ownership of the alarm system.
WARRANTY EXCLUSIONS
The warranty does not apply to products on which the original identification marks have been removed
or modified and does not apply to and does not cover loss or damage for any defects or failures
resulting from an accident, shock, negligence or misuse; a failure or defect in the electrical supply; in
an external electrical circuit; lightning; the use of parts not supplied by ABTYS and unauthorized
repaired work; prolonged immersion having degraded components; any unusual physical or electrical
constraint; modification, adjustment, repair, maintenance or installation of a part by any other party
than ABTYS approved subcontractors and retailers or due to any other cause which, at ABTYS's
discretion, does not result from a defect in materials and workmanship .
The warranty does not apply to normal discoloration, fading, or minor deteriorations of exterior
surfaces resulting from exposure to the elements, except if it affects performances.
WARRANTY DISCLAIMERS
EXCEPT FOR THE WARRANTIES SET FORTH ABOVE, MG INTERNATIONAL HEREBY
DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESSED
OR IMPLIED, WHETHER ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE,
INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Proper installation, use and maintenance are the responsibility of the user. ABTYS shall not be
liable and assumes no responsibility, and users renounce to any right of action against
ABTYS, for any damages arising out of any breach of warranty and for any loss, injury or
damage to persons or property, including but not limited to accidental, consequential, special
damages, financial loss, all damages due to weather and acts of god, and for the death of any
person arising from the purchase, use of the alarm system or inability to use the alarm,
operation or maintenance of the TRITON.

IS NOT A REPLACEMENT FOR COMMON SENSE OR INDIVIDUAL RESPONSIBILITY.
SWIM ALERT'S PURPOSE IS NOT TO BE A REPLACEMENT FOR RESPONSIBILITY AND
VIGILANCE BY A PARENT AND/OR RESPONSIBLE PERSON, WHICH REMAIN THE VITAL
FACTOR IN PROTECTING CHILDREN AND DEPENDANT PERSONS.
No clause in this guarantee affects the user's statutory rights.
