Any guarantee obligation will be rendered null and void if repairs or changes have been
made to equipment by persons other than those authorised to do so by BENDER.

BENDER does not accept any liability for direct or indirect collateral or consequential dam-
age regardless of whether this can be attributed to action considered permissible, impermis-
sible or otherwise.

10.4 Warranty and liability

Warranty and liability claims in the event of injury to persons or damage to property are ex-
cluded if they can be attributed to one or more of the following causes:

z

Use of the FTC470XET other than for the intended purpose.

z

Improper installation, commissioning, operation and maintenance.

z

Operation of equipment with faulty safety devices or safety and protective devices which have been
fitted incorrectly or are not in perfect working order.

z

Failure to comply with the information in the operating instructions regarding transport, storage,
assembly or installation, commissioning, operation and maintenance.

z

Constructional changes made by parties other than the manufacturer.

z

Non-observance of technical data.

z

Repairs carried out incorrectly and the use of replacement parts or accessories not approved by the
manufacturer.

z

Cases of disaster and force majeure.
