DISPUTES
Where allowed by law, by signing this Limited Warranty, you irrevocably agree to first mediate any contemplated legal action alleging
breach or arising out of this Limited Warranty (“Vanderhall NA Dispute”) and otherwise agree to binding arbitration for such legal actions
as follows:
Governing Law: Any Vanderhall NA Dispute is governed by and construed under Utah law, without regard to its rules regarding conflicts of
law. You agree to be subject to personal jurisdiction in any court in Utah where Vanderhall NA is subject to personal jurisdiction. Any
Vanderhall NA Dispute shall take place in as outlined below and thereafter in courts located in the state of Utah.
Arbitration: You agree to submit any Vanderhall NA Dispute to final and binding arbitration under the Commercial Rules of the American
Arbitration Association, with arbitration to be held in Utah County, Utah, United States of America. The award of the arbitrator may be
enforced by any court having personal jurisdiction over the party against which the award is to be enforced. To the extent that the
arbitration rules stated herein conflict with the law, you and Vanderhall NA agree to be bound by the laws, regulations, and rules of Utah
regarding arbitration between customers and manufacturers.
Any legal action alleging a breach or arising out of this Limited Warranty must be brought within one (1) year from the date the alleged
breach first occurred or the shortest period allowed under applicable law, whichever is earlier.
