1. WARNING—
The installed programs are protected by copyright and international treaties. Unauthorized reproduc-
tion or distribution of these programs, or any portion of them, may result in severe civil and criminal penalties and
prosecution to the maximum extent possible under law.
2. NOTICE—
ONKYO licenses the accompanying software to you only upon the condition that you accept all of the
terms contained in this license agreement. Please read the terms carefully before using the software. If you do not
agree to these terms, please do not to use the software, as ONKYO is unwilling to license the software to you, in
which event you should return the full product with proof of purchase to the dealer from whom it was acquired
within 30 days of purchase, and your money will be refunded.
3. LIMITED LICENSE—
The software which accompanies this license (the “Software”) is the property of ONKYO
or its suppliers and is protected by copyright law and/or international treaty provisions. You may not remove the
copyright notice from any copy of this Software or any copy of written materials, if any, accompanying the Software.
While ONKYO continues to own the Software, you will have certain rights to use the Software after your acceptance
of this license. Your rights and obligations with respect to the use of this Software are as follows:
YOU MAY:
a. use the Software only on the NVS-7.7.
b. after written notice to ONKYO, transfer the Software on a permanent basis to another person or entity, provided
that you retain no copies of the Software and the transferee agrees to the terms of this agreement; and
c. if a single person uses the NVS-7.7 on which the Software is installed at least 80% of the time, then after
returning the completed product registration card which accompanies the Software, that person may also use the
Software on the NVS-7.7.
YOU MAY NOT:
a. copy the documentation which accompanies the Software;
b. sub-license, sell, rent, or lease any portion of the Software;
c. reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source code of
the Software, or create derivative works from the Software; or
d. use a previous version or copy of the Software after you have received a set of replacement discs or an upgraded
version as a replacement of the prior version. Upon receipt of an upgraded version, all copies of the prior version
must be destroyed.
4. NO WARRANTY—
Any use by you of the Software is at your own risk. The Software is provided for use only with
the NVS-7.7 and related Software is provided for use “as is” without warranty of any kind to the maximum extent
permitted by law. ONKYO and its suppliers disclaim all warranties of any kind, either expressed or implied, includ-
ing without limitation implied warranties of merchantability, fitness for a particular purpose, title, and no infringe-
ment. ONKYO is not obligated to provide any updates or upgrades to the Software.
5. NO LIABILITY FOR DAMAGES—
In no event will ONKYO or its suppliers be liable for any damages, whatever,
including without limitation, any incidental, direct, indirect, special, consequential or similar damages, damages for
loss of business or other profits, business interruption, loss of business information, or any other pecuniary loss,
arising out of the use or inability to use this Software, even if ONKYO has been advised of the possibility of such
damages. Because some states/countries do not allow the exclusion or limitation of liability for consequential or
incidental damages, the above limitation may not apply to you. In no case shall ONKYO’s liability exceed the
purchase price of the Software. The disclaimers and limitations set forth above shall apply regardless of whether you
accept the Software.
6. INDEMNIFICATION BY YOU—
If you distribute the Software in violation of this agreement, you agree to
indemnify, hold harmless and defend ONKYO and its suppliers from and against any claims or lawsuits, including
but not limited to, attorney’s fees that arise or result from the use or distribution of the Software in violation of this
agreement.
7.
THIS AGREEMENT shall be construed according to the substantive laws, but not the choice of law rules, of the
State of New Jersey and applicable federal laws of the United States. If any dispute arises under this Agreement, the
parties agree that the jurisdiction for such dispute will be in the state and federal court in New Jersey. This agreement
may only be modified by a written document which has been signed by both you and ONKYO. Should you have
