Terms and Conditions of the Warranty
WARRANTY: The Seller warrants products of its manufacture to be
free from defects in workmanship and material (except in those cases
where the materials are supplied by the Buyer) under normal and
proper use and service for as long as you own your Remote Annex
(not transferable).
The Seller agrees to repair or replace at the place of manufacture,
without charge, all parts of said products which are returned at the
Buyer’s expense for inspection, to the Seller’s factory within the
applicable warranty period provided such inspection discloses to the
satisfaction of the Seller that the defects found are as above specified
and provided also that the product has not been altered or repaired,
other than with the Seller’s authorization and by the Seller’s
approved procedures, subjected to misuse, improper maintenance,
negligence, or accident, damaged by excessive current or otherwise,
had its serial number or seal or any part of thereof altered, defaced,
or removed. Products of non-Seller manufacture not incorporated
into the Seller’s equipment at the Seller’s factory shall be and is hereby
excluded from the provisions of this warranty. If, after inspection by
Seller, product is not found to be defective, Buyer will be invoiced for
said inspection and test at the then current repair charge, whether
product is or is not in warranty. In addition, it is expressly agreed by
the Buyer, in purchasing the products, that the liability of the Seller,
if any, shall be limited solely to the replacement and repair of the
products in accordance with the warranties specifically and expressly
set forth herein. The remedies of the Buyer are the exclusive and sole
remedies available, and, in the event of a breach of repudiation of any
provision of this agreement by the Seller, the Buyer shall not be
entitled to receive any incidental damages as that term is defined in
Section 2-715 of the Uniform Commercial Code. The Buyer waives
the Benefit of any rule that disclaimer of warranty shall be construed
against the Seller, and agrees that such disclaimers herein shall be
construed liberally in favor of the Seller.
