General Guarantee Conditions - ZIGLER Polska Sp. z o.o.
§1. This Guarantee shall cover defects of the Product caused by defective parts or workmanship defects.
§2. This Guarantee shall provide for free-of-charge spare parts needed for repairs and for labour for a guarantee period of 24 months
(except for electric drives and control touch-screen panels for machines that are covered by a 12-month guarantee), beginning with the
date of commissioning of the equipment at the PRINCIPAL’S. The guarantee period shall be extended by the time of repairs and shut-
downs resulting from equipment malfunction. The Guarantee shall not cover costs of transfers to the PRINCIPAL in order to remedy the
defect if the business seat of the PRINCIPAL is outside the territory of Poland. In such case, the PRINCIPAL shall be required to cover the
travel costs of the representative of the AGENT’s service staff and the cost of their accommodation if deemed necessary and the
provision of local means of transport. Additional information about guarantee services is included in Appendix No 3.
§3. The PRINCIPAL shall notify the AGENT about any defect found within the quality guarantee period within 3 days of its occur rence.
The AGENT shall respond in writing to the notice and shall set a time limit for remedying the defect. Any arisen defect or flaw must be
reported by email to:

§4. The AGENT shall be required, within the guarantee period, to remove the defect or flaw of the products as soon as possible , within
a time agreed by the parties, but not later than 30 working days from the date of the defect or flaw having been notified.
§5. The guarantee shall not cover equipment with mechanical damage which are not caused by the fault of the AGENT and:
a) equipment malfunctioning or damaged as a result of misuse or negligence of the User as well as of the use thereof contrary to the
operating manual and safety regulations.
b) equipment malfunctioning or damaged due to fire, flood, lightning, or other natural disasters, war or social unrest, unforeseen
accidents and normal wear and tear.
c) equipment in which any person other than the AGENT’s authorised service staff (including the PRINCIPAL) interfered in any way or
made any changes or modifications to the equipment.
d) equipment where serial numbers have been removed or erased in any way whatsoever.
e) sealing, clamping jaws, clamping jaw expansion pin, V-belts, safety housing glazing,
§ 6. Any defective components or parts after replacement shall become the property of the PRINCIPAL.
§ 7. This guarantee shall apply only to the equipment manufactured and supplied by ZIGLER POLSKA.
§8. The operation of the equipment, used in accordance with the operating and maintenance conditions as described in the
maintenance and operating manual, is guaranteed.
§ 9. The guarantee shall cover the correct operation of the equipment only with components supplied by the PRINCIPAL in accordance
with the agreement entered into.
§10. In the event of failure to comply with the manufacturer's recommended service activities described in the Agreement and f ailure
to comply with the instructions contained in the equipment manual, the terms and conditions of this guarantee shall cease to apply.
§11. The PRINCIPAL shall be required to perform periodic maintenance/service checks/inspections of the purchased equipment usi ng
the Manufacturer's services at intervals consistent with the information contained in the manual.
§12. The cost of mandatory maintenance service under the Guarantee is specified in Annexes 2 and 3 to this Agreement and shall be
borne entirely by the PRINCIPAL.
§13. If the AGENT determines during consideration of the claim that the damage is due to a mechanical or deliberate factor, or if it
finds tampering with the components by persons not authorised by the AGENT (including any changes to the design and construction
of the equipment, incorrect installation, operation not in accordance with the manual instructions, any mechanical, electrical and
pneumatic interference), the AGENT shall have the right to charge repair costs in accordance with the price list (Annexes 2 and 3) with
disregard to the guarantee requisition. In such a case the AGENT shall be entitled to deprive the PRINCIPAL of the guarantee service.
