Paiements exigés lorsque le client a à sa charge une partie du

Fabrication à une composante
8. Lorsque, comme il en est fait état aux sections no 6 et 7, le
client a à sa charge le coût de la main-d’œuvre, les frais
d’expédition et la totalité ou une partie du coût des matériaux
requis pour la réparation d’un Défaut de Fabrication à une
composante, le client versera à Taïga Zone, avant le début de la
réparation, un montant égal à la moitié de la somme du coût de
la main-d’œuvre à sa charge plus la moitié de sa part du coût
des matériaux établie de la manière prévue à la section no 9. À
la fin de la réparation, le client paiera immédiatement à Taïga
Zone un montant égal à l’autre moitié du coût de la main-
d’œuvre plus l’autre moitié de sa part du coût des matériaux.

9. Le coût des matériaux utilisés dans la réparation d’un Défaut de
Fabrication d’une composante effectuée entre le début de la
troisième année de la garantie et la fin de la dernière année de
la garantie sera réparti entre le client et Taïga Zone comme suit :
pour la composante à réparer, la part du client correspondra au
coût des matériaux indiqué au devis de coûts dont il est fait état
à la section no 6 multiplié par le pourcentage qui représente la
valeur amortie de la composante à réparer, tandis que la part de
Taïga Zone correspondra au coût des matériaux indiqué au devis
de coûts multiplié par le pourcentage qui représente la valeur
non amortie de la composante. Le tableau qui suit à l’annexe no
1 indique, pour ce qui a trait aux coûts des matériaux, les années
de la garantie durant lesquelles la réparation est effectuée et les
pourcentages qui correspondent à la valeur amortie et non
amortie de la composante.
Les réparations de Défauts de Fabrication n’entraînent pas une
prolongation de la durée de la garantie
10. Les réparations de Défauts de Fabrication faites aux
composantes n’entraînent pas une prolongation de la durée de
la garantie des composantes. La garantie, comme il en est fait
état à la section no 3, entre en vigueur à la date d’achat
indiquée au contrat d’achat et expire à la fin de la quinzième
année suivant ladite date d’achat.
Apparence des composantes après une réparation
11. Taïga Zone s’efforcera de préserver l’apparence qu’avaient
les composantes avant leur réparation, mais ne peut le garantir
au client.
Exclusions de la garantie
12. Les dommages, dégradations et changements d’apparence
énumérés ci-dessous ne sont pas causés par des Défauts de
Fabrication des composantes et n’engagent nullement la
responsabilité de Taïga Zone :
a)
Les dommages à la piscine causés par des matériaux,
de l’équipement et des accessoires ajoutés par le client
qui gênent, entravent ou bloquent le fonctionnement de
la piscine.
b)
Les dommages causés par une présence d’eau
importante accumulée au sol, la présence de gazon ou
paillis au pourtour de la piscine, une piscine
entièrement vide, un gel en profondeur, ou l’action du
gel-dégel.
Payments required when the Customer is Liable for a
Share of the Costs related to the repair of a
Manufacturing defect in a Part
8. in the event, as stated in Sections 6 and 7, that the
Customer is required to assume all labour and freight
costs as well as all or a portion of the material costs
related to the repair of a Manufacturing defect in a
Part, the Customer shall pay Taïga Zone, prior to the
start of repairs, an amount equivalent to half of the
labour costs to be assumed by the Customer plus the
Customer’s share of material costs, established as per
Section 9. upon completion of repairs, the Customer
shall immediately pay Taïga Zone an amount equivalent
to the other half of the labour costs and the other half
of the Customer’s share of the material costs.
Allocation of Costs for Materials used in the repair of
Manufacturing defects in Parts Performed Between the
Start of the Third year of the Warranty Period and the
end of the Last year of the Warranty
9. The cost of materials used to repair Manufacturing
defects of Parts between the start of the 3rd year and
the end of the last year shall be divided between the
Customer and Taïga Zone as follows: for each Part
repaired, the Customer’s share will correspond to the
cost of materials as indicated in the cost estimate
referred to in Section 6 multiplied by the percentage
representing the amortized value of the Part to be
repaired, while Taïga Zone’s share will correspond to
the cost of materials as indicated in the cost estimate
multiplied by the percentage representing the Part’s
non-amortized value. The amortization schedule for
material costs (Appendix 1) indicates the years of the
warranty period in which repairs are performed and the
percentages corresponding to the amortized and non-
amortized values of the Parts.
The repair of Manufacturing defects does not result in
an extension of the Warranty Period
10. The repair of Manufacturing defects in Parts does
not result in the extension of the warranty period for the
Parts. The warranty, as stated in Section 3, comes into
effect on the purchase date indicated in the sales
contract and expires at the end of the fifteenth year
following the said date of purchase.
Appearance of Parts Following repair
11. Taïga Zone will make every effort to preserve the
appearance prior to repair of the Parts, but is unable to
warrant to the Customer that it will be able to do so.
Warranty exclusions
12. The following instances of damage, deterioration
and change in appearance are not caused by
Manufacturing defects in Parts and shall in no way
impose any liability on Taïga Zone:
a)
damage to the pool resulting from materials,
equipment and accessories furnished and
installed by the Customer that impede or
interfere with the normal operation of the pool.
b)
damage caused by a major accumulation of
water in the ground, the effect of keeping a
pool entirely empty, a deep freeze or the effects
of the freeze/thaw cycle.
