2.5. WARRANTY
2.5.1. WARRANTY CONDITIONS
The manufacturer or its representative guarantees that the parts making up the product are new and have been designed and
developed to meet the product technical specifications.
The warranty period is:
s¬
12 months
(twelve months) if the purchaser is an enterprise ( “B to B”, i.e.
“business to business”
)
s¬
24 months
(twenty-four months) if the purchaser is a consumer ( “B to C” i.e.
“business to consumer”
).
The warranty is valid from the date the product is delivered and, more specifically, from the date the testing certificate is signed, if the
machine has been tested, or the date on the delivery document in all other cases. For
“B to B”
sales, the warranty period may not in
any case exceed 18 months from the date the machine was delivered.
Upon delivery the purchaser is required to check:
s¬
that the machine is intact and complete with all parts.
In the event of damage or defects on the product during the warranty period, the purchaser is required to notify the seller, in writing,
of the presence and extent of such damage or defects no later than 5 (five) days from when such were discovered, for “B to B” sales.
The warranty only covers free-of-charge replacement or repair of faulty parts, assessed as being such following careful examination by
the seller’s technical department. The seller shall pay any transport costs and consequently choose the best method for shipping the
material at its sole discretion. Replacements or repairs of parts under warranty do not extend the term of such warranty. In no case
shall the purchaser be able to claim repair of the machine or its individual components if the agreed price has not been paid in full.
2.5.2. WARRANTY EXCLUSIONS
This warranty is automatically void if the product is worked on, modified or used by technicians or personnel not authorised in writing
by the seller.
This warranty does not cover the replacement of parts subject to normal wear and spare parts. Any additional costs, such as travel,
transport and/or personnel costs, are excluded from the warranty. The warranty in no circumstances covers loss of profit or any direct
or indirect consequences of such.
The warranty is automatically void
(in addition to the conditions described in the supply contract) if:
s¬
non-original spare parts are used;
s¬
damage is due to operating errors by the purchaser and/or its personnel;
s¬
damage is due to insufficient maintenance;
s¬
the user carries out repairs at its own discretion without the manufacturer’s consent;
s¬
the instructions provided in this manual have not been observed;
s¬
exceptional events;
in addition:
s¬
removal of the safety devices fitted on the machine will automatically void the warranty and may only be
performed by the manufacturer.
The seller does not accept any liability for damage due to negligence, neglect, improper and incorrect use of the machine and all parts
subject to normal wear during operation, inexperience and lack of care by the purchaser or its employees and/or the final customer/
user and/or its employees, unallowable overloading, unsuitable working equipment and/or materials, defects in the foundations and
structures on the site where the machine is operated (if specific characteristics are required for the site where the machine is located
and installed) and any other activity that is irrelevant or not compliant with normal use of the product or its technical specifications, as
well as damage caused by modifications and/or repairs, replacement of individual components, maintenance performed by personnel
not authorised in writing by the seller and any other circumstance independent of the seller, negligence or inexperience in assembly by
the purchaser and/or the final customer/user.
