3. In the room where the appliance has to be used the temperature must be higher than the temperature of
freezing point. The appliance must be installed at the place enabling an easy access in case of
necessary repair, service or replacement. In case of assembly, installation and operation of a water
heater positioned at untypical places (e.g. lofts, internal rooms sensitive to water, boxes etc.) the
possibility of water drain must be taken into account and in accordance with it the relevant steps (water
collection and its drain) must be taken in order to prevent possible damage. In these cases the material
liability cannot be applied to possible damage
4. The guarantee does not apply to the faults caused by:
•
Incorrect transport, fair wear and tear, intentional damage or faults arisen due to negligence, use of
any force, damage caused by frost or one-shot excess of working pressure indicated on the
specification label, by using an unattested water fitting or incorrect connection of hot water circuit
and also by using an incorrect and non-functional fitting;
•
Breaking the glass or plastic part; any colour differences, damage due to the incorrect use,
especially in case of failure to observe the Installation and operation manual, damage caused by
external agents, connection to the mains with incorrect voltage, damage caused by corrosion due to
the use of aggressive water / water not suitable for drinking water in accordance with national
standards, natural calcium development, insufficient water flow, fire, flood, lightning stroke,
overvoltage, supply breakdown or other forces majeure.
•
Intrusion of foreign matters that have electrochemical effects (e.g. compounds), failure to adhere to
the documentation, failure to replace the protector-type anodes in defined intervals, irregular
cleaning or no cleaning at all, deviations from the standard that result in reduced value of appliance
or its functionality even to a small extent.
•
It is necessary to observe all regulations according to DIN 1988 (EN 806) or related local national
standards and regulations.
5. A well-founded complaint must be reported to the nearest service centre. The manufacturer reserves the
right to repair or replace the faulty part or he decides on the replacement of the faulty appliance by a
functional one in the same value. The manufacturer also reserves the right to ask the purchaser to return
the particular appliance.
6. The repairs carried out within the guarantee service only can be done by authorized companies. The
replaced parts are left in manufacturer’s ownership.
If within the service works any water heater repairs prove to be necessary such services are paid
according to the rates of repairs and consumed material.
7. All works carried out without the documented authorization or consent and the works carried out by an
unauthorized company will result in guarantee annulment. The acceptance of costs of repair carried out
by a third party is conditioned by the situation when the manufacturer after having been asked to remove
the fault does not fulfil his obligations regarding the replacement or repair at all or he fails to fulfil them
within the appointed time.
8. The complaints regarding the guarantee, service and maintenance works do not lead to the guarantee
period prolongation.
9. The damage caused by the transport is subject to inspection and possible acceptation if it has been
reported to the manufacturer in writing and not later than on the day following the working day of
delivery.
10. The claims that exceed the scope of guarantee especially those that regard the damage and repeated
damage are excluded if it is admissible on the basis of legal regulations. The purchaser undertakes to
pay the proportional costs of labour and time necessary to restore the appliance into former status. The
guarantee provided in accordance with this guarantee statement only includes the repair or replacement
of the appliance. The manufacturer’s Terms of sale and delivery are still valid unless they were changed
by conditions of this guarantee.
11. The services provided outside the terms of this guarantee must be paid.
12. The appliance must be fully paid and the party lodging the claim must fulfil all its duties to its supplier if
the guarantee complaint has to be admitted by the manufacturer.
13. The enamelled internal boiler of the water heater is covered by an guarantee for 60 months from the
date of sale on condition that the points 1 – 11 indicated in the conditions for guarantee have been
fulfilled. In case the conditions for guarantee have not been satisfied there will apply the legal claims on
guarantee valid in the country where the appliance was delivered.
14. Satisfaction of claims in accordance with Czech law of Product liability
Claims for damages by virtue of product liability are substantiated only in case all resources required and
necessary for a faultless and admissible use of the appliance have been satisfied. These terms also
include:
The recommended and registered anode replacements; connection to the main with adequate working
voltage; prevention of damage caused by incorrect use, etc. From the above terms we can derive that if
all requirements (standards, service and installation manual, general directives etc.) are met the
appliance or product cannot get damaged. Also the lodged claims must be documented with data such
as the part or the heater number, invoice and description of the subject of claim (description of the fault)
