12. Warranty
ONLINE USV-Systeme AG (ONLINE) warrants that this product will be free of
defects in materials and workmanship for a period of two years from the date
of purchase. The extent of ONLINE’s liability under the terms of this warranty
is limited to the repair or replacement (course of action to be decided by
ONLINE) of any faulty products. Where maintenance work is covered by the
warranty, there shall be no entitlement to have such work carried out unless
an RMA number (Returned Material Authorization) has first been obtained
from Customer Service. When returning products, the sender must bear all the
shipping and postage costs and include a short description of the problem that
has arisen plus proof of the date and place of purchase. Appliances that have
sustained accidental damage, have been damaged as a result of negligence
or misuse or have been altered or modified in any way are not covered by this
warranty.
SAVE FOR ANY EXCEPTIONS AS HEREIN PROVIDED FOR, ONLINE
MAKES NO GUARANTEES (WHETHER EXPLICIT OR IMPLICIT) OF ANY
KIND, INCLUDING IN RESPECT OF ASSURANCES OF STANDARD QUAL-
ITY OR THE SUITABILITY OF ITS PRODUCTS FOR A SPECIFIC PUR-
POSE. Some jurisdictions do not permit the limitation or exclusion of implicit
guarantees, with the result that some of the above restrictions or exclusions
may not apply to all purchasers.
SAVE FOR ANY EXCEPTIONS AS HEREIN PROVIDED FOR, UNDER NO
CIRCUMSTANCES CAN ONLINE ACCEPT ANY LIABILITY FOR DIRECT
OR INDIRECT DAMAGE, SPECIAL KINDS OF DAMAGE OR COLLATORAL
OR CONSEQUENTIAL DAMAGE SUSTAINED AS A RESULT OF USING
THIS PRODUCT, EVEN IF ONLINE WAS INFORMED ABOUT THE POSSI-
BILITY OF SUCH DAMAGE ARISING. In particular, ONLINE accepts no
liability for costs of any description such as lost profits or income, the loss of
equipment, the inability to use equipment, the loss of software or data, costs
associated with obtaining replacements, claims by third parties or other costs.
