6.1 ADDENDUM I
– STABILITY BAR REFUSAL
This Stability Bar Refusal - Addendum (“Addendum”) is part of the Assumption of Risk and Release of Claims
(“Agreement”) entered into by the GolfBoard Owner (“Owner”), and Owners’ parent/guardian if Owner is less than
eighteen (18) years old, in favor of Sol Boards Inc. (“Sol Boards”) and certain third-party beneficiaries as a condition
of User leasing and using a GolfBoard™ four-wheel drive electric board (together with any related equipment, the
“Board”).
1.
I Know a Stability Bar is Recommended for Safety
. Owner understands that (i)
using a stability bar
while operating the Board may help reduce the incidence of falls, collisions, loss of balance or other
occurrences while using the Board, which in turn may help reduce the risk of serious injury, including
death, while using the Board
; (ii) failure to use a stability bar could increase the safety risks of using the
Board; (iii) Sol Boards and common sense recommend that Owner use a stability bar at all times while
operating the Board; and (iv) Sol Boards includes a stability bar with the Board.
1.
My Eyes are Open, and I’ve Tried this Already.
Owner represents and warrants that User: (i) will play a
minimum of 18-holes of golf while using a Board with a stability bar; (ii) has the physical ability to both
jump and run, and therefore considers themselves to have sufficient physical agility to step off the board
while moving without falling or losing balance; (iii) has been informed of and understands the additional
dangers and risks of using the Board without a stability bar; and (iv) wishes to operate the Board without a
stability bar.
2.
I Don’t Want a Stability Bar – I’ll Take the Additional Risk
.
Against Sol Board’s recommendation,
Owner declines use of stability bar while operating the Board and has decided despite Sol Boards safety
warnings to use board without the stability bar in place. Owner, and Owner’s undersigned
parent/guardian if Owner is a minor, understands that this decision to refuse use of a stability bar
could increase User’s risk of serious injury, including death, while using the Board, and voluntarily
accepts and assumes all additional risks of operating the Board without a stability bar.
3.
This is Part of the Agreement.
This Addendum is specifically incorporated into, and is a part of, the
Agreement. The terms of this Addendum are in addition to, and not in limitation of, any of the other terms
of the Agreement. Owner understands that all provisions in the Agreement—including, without limitation,
the Release of Claims, Limitation of Liability, and Indemnity provisions—extend to this Addendum and to
any claim(s) that could arise from User’s refusal to use of a stability bar.
THIS ADDENDUM WAIVES SUBSTANTIAL LEGAL RIGHTS AND HAS CAREFULLY READ THIS ENTIRE
ADDENDUM. THE GOLFBOARD OWNER CONSENTS TO ALL TERMS OF THIS ADDENDUM FREELY
AND VOLUNTARILY WITH THE INTENT OF BEING LEGALLY BOUND BY IT.
