This Limited Warranty does not cover any defect that arises or appears more than thirty (30) days prior to
the date that Sol Boards is notified of the alleged defect pursuant to the procedures set forth below.
This Limited Warranty does not cover Boards purchased or situated outside of the United States.
What is the period of coverage?
This Limited Warranty commences on the date of the original purchase of the new Board from Sol Boards
or an authorized Sol Boards dealer (“Purchase Date”) and remains in effect for the period of one (1) year
from the Purchase Date (the “Warranty Period”).
The Warranty Period is not extended if any Board or Part is repaired or replaced. A repaired or replaced
Board or Part is warranted only for the remaining balance of the original Warranty Period, if any.
Who is covered?
This Limited Warranty covers the original purchaser of a new Board and anyone else who owns the Board
during the Warranty Period (all of whom may be referred to as a “Purchaser”) during such period of time
as they own the Board. A Purchaser may assign the Purchaser’s warranty rights under this Limited
Warranty to a commercial lessee of the Board to whom the Purchaser grants sole possession and control of
the Board pursuant to a written lease agreement. Lessee may have other Board maintenance and repair
obligations that go beyond those indicated in this limited warrantee as are described in Sol Boards’ Couse
Acknowledgement agreement. Rentals to consumers or users (i.e. golf course rentals to customers) are
specifically excluded from the above assignment rights.
What will Sol Boards do to correct problems?
If Purchaser returns a defective Board or Part to Sol Boards in accordance with the procedure described
below in this Limited Warranty, Sol Boards will examine the Board or Part and determine whether it is
covered under this Limited Warranty. If Sol Boards determines that the Board or Part is not covered by
this Limited Warranty for any reason, Sol Boards will notify Purchaser, and may inform Purchaser
regarding service alternatives that may be available on a fee basis for both labor and replacement parts,
including the cost of labor to provide a detailed estimate for a fully completed repair of the board. If Sol
Boards determines that the Board or Part is covered under this Limited Warranty, Sol Boards will, at is sole
option, provide one of the following three remedies:
1.
Repair
, or facilitate the repair of, the defective Board or Part within a reasonable period of time
and free of charge for the necessary parts and labor to complete the repair, including free installation
of the repaired Part into the Board if Purchaser delivers the Board (at Purchaser’s expense) to Sol
Boards – if the Board is not delivered to Sol Boards, Purchaser, at Purchaser’s expense, shall be
responsible for installing any such repaired Part at Purchaser’s expense;
2.
Replace
the Board or Part with the same or reasonably equivalent product or part, including free
installation of the replacement Part into the Board if Purchaser delivers the Board (at Purchaser’s
expense) to Sol Boards – if the Board is not delivered to Sol Boards, Purchaser, at Purchaser’s
expense, shall be responsible for installing any such replacement Part at Purchaser’s expense; or
3.
Issue a refund
of the lesser of (i) the original purchase price actually paid by the original Purchaser,
less depreciation in an amount to be determined by Sol Boards based on the age and condition of
the Board; or (ii) the amount paid for the Board by a subsequent Purchaser, less depreciation in an
amount to be determined by Sol Boards based on the age and condition of the Board.
