(a) The owner or operator of an aircraft is primarily responsible for maintaining
that aircraft in an airworthy condition, including compliance with part 39 of this
chapter.
(b) No person may perform maintenance, preventive maintenance, or alterations
on an aircraft other than as prescribed in this subpart and other applicable
regulations, including part 43 of this chapter.
There is no exception for experimental aircraft here.
I’ll repeat this again, many pilots are under the mistaken impression that the
FAR’s that apply to normally certificated aircraft do not apply experimental/
amateur built aircraft. This is not completely correct. 14 CFR 43.1 states:
Section 43.1: Applicability.
(a) Except as provided in paragraphs (b) and (d) of this section, this part
prescribes rules governing the maintenance, preventive maintenance,
rebuilding, and alteration of any—
