Warranty

Datacom Systems, Inc. (DSI) warrants that the hardware which it
supplies will be free from significant defects in materials and work-
manship for a period of two years from the date of delivery
(Warranty Period), under normal use and conditions. 

In the event of a problem with a switch;
• Contact Datacom Customer Service for determination that the

switch requires replacement

• DSI will ship a functionally equivalent replacement switch to you

within one business day by prepaid overnight air

• Return the failed switch, freight prepaid, with the Datacom

Customer Service RMA number clearly marked on the outside of
the package, to arrive within ten days at Datacom Systems Inc.,

Customers outside North America, contact DSI regarding timing of
a replacement switch, but shipping, handling, and duty charges to
and from the factory will be the customer’s responsibility.

In the event of other than a switch defect, contact Datacom
Customer Service for assistance and Datacom will repair or replace
the defective equipment and send it to you, freight prepaid. If DSI
determines that the equipment is not defective, it will return it to
you, freight collect.

ALL ITEMS FOR RETURN MUST HAVE A RETURN MATERIAL
AUTHORIZATION (RMA) NUMBER FROM DATACOM CUSTOMER
SERVICE AT (315) 463-9541. ITEMS WITHOUT AN RMA WILL BE
REFUSED OR RETURNED FREIGHT COLLECT.

DSI shall have no responsibility for any deficiency resulting from
accidents, misuse, modifications, power disturbances (e.g., lighten-
ing, ESD, use of a power supply not specified by DSI, etc.), or var-
ious other forms of disaster, e.g., earthquakes, floods, etc. If
returned equipment is found to have failed under any of these cir-
cumstances, the customer will be invoiced for repair or replace-
ment of that switch or hardware.

Limitation On Liability

The warranties set forth above are exclusive and in lieu of all other
warranties. Datacom Systems, Inc. (DSI) makes no other war-
ranties, expressed or implied, and DSI expressly disclaims all other
warranties, including but not limited to implied warranties of mer-
chantability and fitness for a particular purpose. Moreover, the pro-
visions set forth above state DSI’s entire responsibility and your
sole and exclusive remedy with respect to any breach of warranty
or contract.

No liability for consequential damages. Under no circumstances
and under no theory of liability shall DSI be liable for costs of pro-
curement of substitute products or services, lost profits, lost sav-
ings, loss of information or data, or any other special, indirect, con-
sequential or incidental damages, arising in any way out of the sale
of, use of, or inability to use, any DSI product or service, even if
DSI has been advised of the possibility of such damages.
