12. Wafian HR-F1 One (1) Year Limited Warranty
Wafian’s warranty obligations are limited to the terms set forth below:
Wafian Corporation (“Wafian”) warrants the hardware product against defects in materials and workmanship for a
period of ONE (1) YEAR from the date of original purchase. If a defect exists, Wafian will, at its option, (1) repair
the product at no charge, using new or refurbished replacement parts, (2) exchange the product with a product
that is at least functionally equivalent to the original product. A replacement product/part assumes the remaining
warranty of the original product or ninety (90) days from the date of the replacement or repair, whichever
provides longer coverage for you. When a product or part is exchanged, any replacement item becomes your
property and the replaced item becomes Wafian’s property.
Prior to returning a product to Wafian, you must request a RMA number. Please contact Wafian at 858-863-4166
option 2 or [email protected] to explain the problem and request an RMA number. The RMA number must be
included with the package and be labeled on the box. Upon receiving the RMA number, deliver the product at
your expense to Wafian.
When you contact Wafian for warranty service, please be prepared to provide your name, address, telephone
number, and a copy of the bill of sale bearing the appropriate Wafian serial numbers as proof of date of the
original purchase. In addition, you will need to include the RMA number for processing and tracking as
mentioned above.
This Limited Warranty applies only to hardware products manufactured by or for Wafian that can be identified by
the “HR-F1” trademark, trade name, or logo affixed on them.
Wafian software is warranted pursuant to a
separate Software License Agreement included with the software.
This Limited Warranty does not
apply to any non-Wafian products even if packaged or sold with Wafian hardware. Non-Wafian products may
provide their own warranty. This warranty does not apply and maybe void if the product has been damaged by
accident, abuse, misuse, or misapplication; if the product has been modified without the written permission of
Wafian; or if any Wafian serial number has been removed or defaced. Wafian reserves the right to use both new
and refurbished components during the repair process for any unit under warranty that has been approved for
repair.
The Warranty and remedies set forth above are exclusive and in lieu of all others, whether oral or written,
expressed or implied. Wafian specifically disclaims any and all implied warranties, including, without limitation,
warranties of merchantability and fitness for a particular purpose. No Wafian distributor, agent, or employee is
authorized to make any modification, extension, or addition to this warranty.
WAFIAN IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
RESULTING FROM ANY BREACH OF WARRANTY, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT
LIMITED TO LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND
PROPERTY, AND ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA
STORED IN OR USED WITH WAFIAN PRODUCTS. Some states do not allow the exclusion or limitation of
incidental or consequential damages or exclusions or limitations on the duration of implied warranties or
conditions, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal
rights, and you may also have other rights that vary by state.
WAFIAN IS NOT RESPONSIBLE FOR WARRANTY REPAIRS OR REPLACEMENT IF THE PRODUCT OR PRODUCTS
HAVE NOT BEEN PAID FOR IN FULL. IF THERE ARE OTHER INVOICES THAT HAVE NOT BEEN PAID IN FULL, NO
WARRANTY WILL BE AVAILABLE FOR THE PRODUCT OR PRODUCTS UNTIL THE ACCOUNT IS PAID IN FULL.
