Warranty
WARRANTY
. The Vendor warrants for the benefit of the Purchaser,
and not for any other person, that each new Utilicor product sold by
it, or by any of its authorized distributors, will be free from defects in
workmanship and material under normal use and service for a
period of twelve (12) months from the date of delivery to the
original Purchaser, provided that this warranty shall not apply to any
Utilicor product which has been subjected to misuse, negligence or
accident or which shall have been altered or repaired by anyone
other than an authorized Utilicor representative in any way which, in
the Vendor’s judgment, might affect its stability or reliability, nor to
normal wear and tear, operating costs and adjustments, including
but not limited to adjusting pressure settings, limit switches, timers,
relays, fuses, loss of hydraulic oil, cable replacement or filter
replacement. Vendor’s obligation under this warranty is limited to
repairing or replacing, as hereinafter provided, at its option, any part
or parts of said product found, to the Vendor’s satisfaction, to be
defective upon examination and provided that such part or parts
shall be returned to the Vendor’s facility at no cost to the Vendor.
Labor charges to install any replacement part will be allowed in
accordance with the Vendor's schedule of applicable labor rates.
The Vendor shall not be liable for any freight, travel costs or other
similar costs in connection with this warranty and the Purchaser
shall be solely responsible for all such costs. All products that are
not manufactured by or on behalf of the Vendor, including but not
limited to engines and motor vehicles, power control systems,
electric motors, hydraulic cylinders and pumps shall be subject to
only the warranty of the manufacturer or vendor of such product.
THIS WARRANTY IS MADE EXPRESSLY IN LIEU OF ANY OTHER
WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED
WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE. VENDOR WILL IN NO EVENT BE LIABLE FOR ANY LOSS OF
BUSINESS PROFITS, DOWNTIME OR DELAY, LABOR, REPAIR OR
MATERIAL COSTS OR ANY SIMILAR OR DISSIMILAR SPECIAL OR
CONSEQUENTIAL DAMAGE WHATSOEVER, NOR FOR ANY SUM IN
EXCESS OF THE PRICE RECEIVED FOR THE GOODS FOR WHICH
LIABILITY IS CLAIMED OR ASSOCIATED.
