If the Product requires warranty service, NET2PHONE will issue an
RMA number to the End-User.

EXCEPT FOR THE EXCLUSIVE REMEDY SET FORTH ABOVE,
IN NO EVENT SHALL NET2PHONE HAVE ANY LIABILITY TO
THE END-USER OR ANY THIRD PARTY FOR ANY CLAIM,
LOSS OR DAMAGE OF ANY KIND, EVEN IF NET2PHONE
HAVE BEEN ADVISED OF THE POSSIBLITY OF SUCH DAM-
AGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS,
CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR
INDIRECT DAMAGES, ARISING OUT OF OR IN CONNECTION
WITH (A) THE PERFORMANCE, USE OF OR INABILTY TO USE
ANY PRODUCT OR ANY DATA, SOFTWARE OR EQUIPMENT
RELATED THERETO OR USED IN CONNECTION THEREWITH
OR (B) INFRINGEMENT OF ANY PATENT, COPYRIGHT,
TRADEMARK OR OTHER INTELLECTUAL PROPERTY RIGHT
OF ANY THIRD PARTY. IN NO EVENT SHALL NET2PHONE’S
LIABILITY FOR DAMAGES, WHETHER ARISING OUT OF CON-
TRACT, NEGLIGENCE, WARRANY OR INFRINGEMENT OF
ANY INTELLECTUAL PROPERTY RIGHT, EXCEED THE PUR-
CHASE PRICE PAID BY THE END-USER FOR THE PRODUCT.

Upon request from NET2PHONE, the End-User must provide docu-
mentation (such as a sales receipt) to reasonably prove the date of 
purchase.

The End-User shall bear the cost of shipping the Product to the
Customer Service Department of NET2PHONE. NET2PHONE shall
bear the cost of shipping the Product back to the End-User after the
completion of service under this limited warranty.

The End-User shall have no coverage or benefits under this limited
warranty if any of the following conditions are applicable:

The Product has been subject to abnormal use, abnormal conditions,
improper storage, exposure to moisture or dampness, unauthorized
modifications, unauthorized connection, unauthorized repair, misuse,
neglect, abuse, accident, alteration, improper installation, or other acts
which are not the fault of NET2PHONE, including damage caused by
shipping and blown parts.

The Customer Service Department at NET2PHONE was not notified
by the End-User of the alleged defect or malfunction of the Product
during the applicable limited warranty period.

End-User Procedures:

In the event that the End-User requires support or warranty service for
the Product, the End-User must contact NET2PHONE by either e-mail
[email protected] or by toll-free telephone (888-581-0842).

NET2PHONE will use reasonable commercial efforts to resolve the
issue by e-mail or telephone.
