WARRANTY.

 the Vendor warrants for the benefit of the Purchaser, and not for 

any other person, that each new the Vendor product sold by it, or by any of its 
authorized distributors or dealers, will be free from defects in workmanship and 
material under normal use and service for a period of twelve (12) months from 
the date of delivery to the original Purchaser, provided that this warranty shall 
not apply to any the Vendor product which has been subjected to misuse, 
negligence or accident or which shall have been altered or repaired by anyone 
other than an authorized the Vendor representative in any way which, in the 
Vendor’s judgment, might affect its stability or reliability, nor to normal wear and 
tear, operating costs and adjustments, including but not limited to adjusting 
pressure settings, limit switches, timers, relays, fuses, loss of hydraulic oil, cable 
replacement or filter replacement.  Vendor’s obligation under this warranty is 
limited to repairing or replacing, as hereinafter provided, at its option, any part 
or parts of said product found, to the Vendor’s satisfaction, to be defective upon 
examination and provided that such part or parts shall be returned to the 
Vendor’s facility at no cost to the Vendor.  Labor charges to install any replace-
ment part will be allowed in accordance with the Vendor's schedule of applicable 
labor rates.  the Vendor shall not be liable for any freight, travel costs or other 
similar costs in connection with this warranty and the Purchaser shall be solely 
responsible for all such costs.  All products that are not manufactured by or on 
behalf of the Vendor, including but not limited to engines and motor vehicles, 
power control systems, electric motors, hydraulic cylinders and pumps shall be 
subject to only the warranty of the manufacturer or vendor of such product.  
THIS WARRANTY IS MADE EXPRESSLY IN LIEU OF ANY OTHER WARRAN-
TY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF 
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  

MAXIMUM LIABILITY.

  Notwithstanding anything to the contrary set out in 

this Purchase and License Agreement, the maximum aggregate liability of the 
Vendor in relation to any matter connected with the Purchase, License or 
Operation of the Equipment or the license of the Vendor Technology, shall be 
limited to the amount paid to the Vendor for the goods for which liability is 
claimed.  Further, the Vendor shall not have any liability to the Purchaser or to 
any other person in relation to the Purchase, License to Use or Operation of 
the Equipment or the license to use the Vendor Technology for any special, 
indirect or consequential damages, including but not limited to loss of profits, 
loss of business opportunities, downtime, delay or loss of business investment.
