The Pandigital Connected Digital Photo Frame (Photo Mail
®
Digital Photo Frame) provides users a fun and easy way to process, share and otherwise use
(collectively "Process") photographs. However, before you use Photo Mail
®
Digital Photo Frame or use any of the Pandigital services, you must carefully review the
Terms and Conditions set out below (the "Terms"). In addition, specific pages on the Site may set out additional terms and conditions, all of which are incorporated
by reference into these Terms. These Terms may be changed or updated at any time, but you can always find the most recent version on our web site at
www.pandigital.net. In the case of inconsistencies between these Terms and information included in off-line materials (for example, promotional materials and
mailers), these Terms will always control.
By powering on and using the Photo Mail
®
Digital Photo Frame, you indicate that you accept these Terms and Conditions and that you agree to be bound by them.
Acceptance of these Terms and Conditions creates a binding contract between you and Pandigital that you will use the Photo Mail
®
Digital Photo Frame only in a
manner consistent with these Terms and Conditions. If you have questions about these Terms, please contact us directly. Your use of the Photo Mail
®
Digital Photo
Frame and its services (together, the "Service") is entirely conditioned on and subject to your compliance with these Terms. If you do not agree with these Terms,
do not access or use the Photo Mail
®
Digital Photo Frame.
Terms of Use
: In order to use the Photo Mail
®
Digital Photo Frame, certain requested information may be sent to Pandigital, including your name and correct email
address. You must provide Pandigital with true, accurate, current, and complete information about yourself when such information is requested by Pandigital
(whether by questionnaires, surveys, registration forms, or other informational requests).
Digital Image Transmission
: Pandigital offers unlimited transmission of photos to the Photo Mail
®
Digital Photo Frame through the built-in cellular connection.
There is no limit to the content others can send to your Photo Mail
®
Digital Photo Frame but you are responsible for all applicable data transmission charges. When
you accept and upload an image to the Photo Mail
®
Digital Photo Frame, you accept the following; you acknowledge and accept the content of the images that are
being sent to you; you acknowledge and accept the related cellular connection charges for the images being transmitted to you; you acknowledge and accept that
the original resolution of your content may be affected. Further, if you upload an image that is too large, Pandigital may in its discretion may down-sample the
image size.
Digital Image Storage
: Images sent to your Photo Mail
®
Digital Photo Frame are delivered to your active device and must be approved or deleted when received.
Pandigital will hold a maximum of five hundred transmitted images on its servers for a minimum of fourteen days from the date of transmission while awaiting
approval or deletion. Any images not approved or deleted within the allotted time frame will be permanently deleted from our servers. Any images transmitted
above the maximum allowed number of images will be deleted from our servers. Pandigital reserves the right to increase or decrease the holding period and/or
quantity limitations for images at its discretion. Under no circumstances will Pandigital be responsible for the loss of any images at any time for any reason.
Non-deliverable Photo Mails
: Pandigital will attempt to deliver all Photo Mails that are received. Photo Mails are considered undeliverable after two delivery
attempts and will be deleted from the Pandigital server.
Content
: Pandigital is committed to ensuring that the Photo Mail
®
Digital Photo Frame remains a fun and safe device to receive photographs and images. To that
end, the Photo Mail
®
Digital Photo Frame allows users to accept photographs and images from any e-mail address. Users of the Photo Mail
®
Digital Photo Frame
or related services may not use the Photo Mail
®
Digital Photo Frame to process Prohibited Content. Generally, Prohibited Content includes content or other
material that Pandigital believes:
1. Is abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, or otherwise inappropriate;
2. Comprises copyrighted material used without the express permission of the owner;
3. Violates or otherwise encroaches on the rights of others;
4. Contains viruses, worms, corrupt files, Trojan horses or other forms of corruptive code, or any other content which may compromise the
Photo Mail
®
Digital Photo Frame or related services (collectively “Corruptive Code”);
5. Advocates illegal activity;
6. Harms anyone, including minors; or,
7. Provides a link to any of the above;
Pandigital has the sole discretion to determine whether Content is Prohibited Content, and any Content submitted to the Service may be subject to examination
from time to time. Although Pandigital does not and will not examine or otherwise review all content submitted or transmitted to the Photo Mail
®
Digital Photo
Frame, Pandigital may delete, move, and edit Content for any reason, at any time, without notice. All content that is processed and received on the Photo Mail
®
Digital Photo Frame is the responsibility of the person who a) sent it and b) approved it on the Photo Mail
®
Digital Photo Frame. Thus, you are responsible for your
content. By accepting images from unknown persons, you may be exposed to content that you consider offensive. You take sole responsibility for such exposure.
Pandigital takes no responsibility or provides no warranty, expressed or implied, for the nature of the content that is transmitted or accepted onto the Photo Mail
®
Digital Photo Frame. In addition, Pandigital in no way guarantees the accuracy, quality, or appropriateness of content available through the Photo Mail
®
Digital
Photo Frame. Pandigital reserves the right to terminate the use and/or connection of Photo Mail
®
Digital Photo Frame at any time for any reason with or without
notice.
