Terms of warranty
ONE:
This guarantee covers a period of FIVE YEARS for GEISER INOX GX and GX4 Series (single wall Storage Tanks), from the invoice date. Under no
circumstances shall this guarantee exceed a period of 5 years and 3 months from the date of dispatch from the factory. Periods of one year run from date to
date and not natural calendar years. The GX6 series of GEISER INOX tanks are excluded from this guarantee, as the terms and conditions of their guarantee
are included in their specific instructions
The commercial guarantee period runs from the THIRD to the FIFTH year inclusive (see clause 5th). Likewise, this guarantee applies to the first item purchased
and no further guarantee is applicable in the event of defective tanks that have been repaired or replaced as per the terms and exclusions listed herein.
TWO:
The scope of this guarantee refers exclusively to defects deriving from the manufacture or the material of the storage tank body. The following cases are
excluded from the guarantee:
1.-
Those due to incorrect installation not in adherence of the installation and user instructions or of current regulations or that may be due to incorrect
use or handling (impacts during movement, etc.) or the malfunctioning of the installations safety elements.
2.-
Damage caused by mishandling or by companies or individuals not belonging to the supply or maintenance company.
3.-
Corrosion due to a chloride concentration in water of more than 150 milligrams per litre (see point 10).
4.-
Damage due to galvanic corrosion caused by attaching items made of a different metal than the tank (such as copper), without using dielectric bushings,
directly in any connection to the tank, in contravention of current regulations.
5.-
Corrosion in the storage tank caused by deposits of copper particles from the cold water inlet/return pipes when such pipes are made of copper (see
point 10).
6.-
Lime scale, build-up of salts, sludge or any other type of dirt in the storage tanks or corrosion resulting from all such fouling.
7.-
Damage caused by improper transport and/or storage.
8.-
As a result of coupling any unsuitable elements to the storage tank that are not specified in the instructions or in current regulations for DHW installations.
9.-
Force majeure.
10.-
In the event of chloride concentrations higher than 150 milligrams per litre or tanks with a copper DHW recirculation circuit, a Lapesa Correx-up
cathodic protection system should be fitted. In this case, the guarantee will cover a period of five years with the terms and exclusions indicated in the previous
clauses, except for point 3 of this clause Two.
11.-
When the tank is fitted with the Lapesa Correx-up cathodic protection kit, the guarantee is totally dependent on the Lapesa Correx-up cathode
protection operating strictly according to its installation and user instructions.
12.-
As a result of corrosion or rust due to faulty installation of the Lapesa Correx-up cathodic protection, when compulsory as per the terms of clause 10
above, or as a result of a temporary or continuous lack of power supply to the equipment, or a faulty installation of the kit that does not comply with the
protection kit instructions.
13.-
As a result of leakage from inspection chambers or manholes where watertight seals have not been replaced each time the tank has been previously
opened for maintenance. Replacement of watertight seals is not covered by the products guarantee as they are parts subject to normal wear.
THREE:
With regard to cathodic protection, heating, regulation and control items or components, as well as items or components of the hydraulic circuit fitted
at factory, the guarantee shall run for a period of 1 year as per the terms and exclusions stated in the two preceding clauses, also adding the circumstance of
corrosion of any part of the heating system, such as immersion heating elements in the secondary circuit, in water with a concentration of chloride of more than
150 milligrams per litre, provided that the equipment is installed in LAPESA tanks operating with water with a conductivity of between 200 y 2000 microScm-1.
FOUR:
All original GEISER INOX series storage tanks include an instructions and users manual as well as installation and positioning diagrams in compliance
with current regulations and any use not contingent to said Manual excludes the beneficiary from the guarantee and all expenses arising from tank repairs,
including materials, shall be borne by the user. Moreover, with regard to GEISER INOX tanks fitted with Lapesa Correx-up cathodic protection equipment, said
equipment must be properly installed according to the instructions given, and should be in constant operation without any interruptions to the power supply (see
installation and users instructions)
FIVE:
The labour relating to inspections of Customer Technical Services, or labour required to carry out the necessary repairs of failures covered by this guarantee,
as well as travelling and delivery expenses related to said repairs, shall be free of charge for the user for a period of 1 year for the materials listed in clause
Three, and for 2 years for the storage tank body, counting from the date this guarantee commences. The guarantee covers the replacement, free of charge, of
any storage tank components that, following inspection by the Quality Department or After-Sales service, are found to have manufacturing and/or material defects.
During the commercial guarantee period between the third and fifth year, the guarantee only covers material, as per the terms and exclusions set forth herein.
SIX:
All repairs and replacements carried out on the storage tank that are due to causes covered by the present guarantee shall have a further guarantee of six
months from the date the repair or replacement takes place. Said repairs and replacements shall not, however, constitute the beginning of a fresh period of guarantee
for the original product. Repairs may only be carried out by companies or technicians duly authorised by LAPESA and any intervention on the equipment by persons
other than LAPESA personnel or without LAPESAs prior authorisation, shall render the guarantee to the beneficiary invalid.
SEVEN:
The storage tank must be installed in an accessible place that enables it to be handled, installed, repaired or replaced without the need for further works,
dismantling/installation of elements or equipment that do not form part of the storage tank, or the use of special transport or lifting gear. In no case does the
guarantee cover the cost of dismantling the equipment where it is installed and particularly, the guarantee does not cover any expense related to building works,
demolition or dismantling of tanks located in places with little or no access to them, nor does it cover the transport or installation of new tanks, or any expense
or damages deriving from the lack of use of the equipment during the repair or replacement time.
EIGHT:
This guarantee is only applicable to Lapesa tanks and their accessories and equipment that operate with drinking water within the value limits legally
established according to European Directive 98/83/CE, 3th November, or in accordance with the regulations in force at the time it is extended, the exception being
the limits for chloride content and range of conductivity of the water in those cases set forth in the preceding clauses. Likewise, this guarantee shall only be
applicable to Lapesa tanks and their accessories and equipment operating with water with a hardness within the ranges established according to UNE 112076:2004 IN
for the prevention of corrosion in water circuits (between 6ºf and 15ºf) or to the regulations in force at the time.
NINE:
This guarantee does not affect legal consumer and user rights and entitlements in the event of product non-compliance with contract. The guarantor is
LAPESA GRUPO EMPRESARIAL, S.L., whose registered offices are at P.I. Malpica, calle A, parcela 1-A, Zaragoza, 50016 Spain, where any claims may be
sent during the guarantee period by conventional post, telephone or e-mail addressed to either the Sales Department or the Customer Technical Service indicated
