Arbitration Rules and Procedures.
To begin
arbitrationofaclaim,eitheryouorCowaymust
make a written demand for arbitration. The
arbitrationwillbeadministeredbytheAmerican
Arbitration Association (“AAA”) and will be
conducted before a single arbitrator under the
AAA’sConsumerArbitrationRulesthatareineffect
atthetimethearbitrationisinitiated(referredto
asthe“AAARules”)andundertheproceduresset
forthinthissection.TheAAARulesareavailable
onlineatwww.adr.org/consumer.Sendacopyof
yourwrittendemandforarbitration,aswellasa
copyofthisprovision,totheAAAinthemanner
describedintheAAARules.Youmustalsosenda
copyofyourwrittendemandtoCowayatCoway
USA, Inc., Attn: Legal Department- Arbitration,

90010.IfthereisaconflictbetweentheAAARules
andtherulessetforthinthissection,therulesset
forth in this section will govern. This arbitration
provision is governed by the Federal Arbitration
Act.Judgmentmaybeenteredonthearbitrator’s
awardinanycourtofcompetentjurisdiction.All
issuesareforthearbitratortodecide,exceptthat
issuesrelatingtothescopeandenforceabilityof
the arbitration provision and to the arbitrability
of the dispute are for the court to decide. The
arbitratorisboundbythetermsofthisprovision.
Governing Law.
The law of the state of your
residenceshallgovernthisLimitedWarrantyand
anydisputesbetweenusexcepttotheextentthat
such law is preempted by or inconsistent with
applicablefederallaw.
Fees/Costs.
Ifyouprevailinthearbitration,Coway
willpayyourattorneys’feesandexpensesaslong
as they are reasonable, by considering factors
including,butnotlimitedto,thepurchaseamount
andclaimamount.Notwithstandingtheforegoing,
ifapplicablelawallowsforanawardofreasonable
attorneys’ fees and expenses, an arbitrator can
award them to the same extent that a court
would.Ifthearbitratorfindseitherthesubstance
ofyourclaimorthereliefsoughtinthedemandis
frivolousorbroughtforanimproperpurpose(as
measured by the standards set forth in Federal
RuleofCivilProcedure11(b)),thenthepayment
ofallarbitrationfeeswillbegovernedbytheAAA
Rules.Insuchasituation,youagreetoreimburse
Coway for all monies previously disbursed by it
whichareotherwiseyourobligationtopayunder
theAAARules.
Hearings and Location.
If your claim is for
$25,000 or less, you may choose to have the
arbitration conducted solely on the basis of
(1) documents submitted to the arbitrator, (2)
through a telephonic hearing, or (3) by an in-
personhearingasestablishedbytheAAARules.If
yourclaimexceeds$25,000,therighttoahearing
willbedeterminedbytheAAARules.Anyin-person
arbitration hearings will be held at a location
within the federal judicial district in which you
resideunlesswebothagreetoanotherlocationor
weagreetoatelephonicarbitration.
Opt Out.
Youmayoptoutofthisdisputeresolution
procedure.Ifyouoptout,neitheryounorCoway
canrequiretheothertoparticipateinanarbitration
proceeding.Tooptout,youmustsendnoticeto
Coway no later than 30 calendar days from the
date of the first consumer purchaser’s purchase
oftheproductbyeither:(i)sendingane-mailto
[email protected] with the subject line:
“ArbitrationOptOut”or(ii)calling1-800-285-0982.
Youmustincludeintheoptoute-mailorprovide
bytelephone:(a)yournameandaddress;(b)the
dateonwhichtheproductwaspurchased;(c)the
productmodelnameormodelnumber;and(d)
theserialnumber(theserialnumbercanbefound
ontheproduct.
You may only opt out of the dispute resolution
procedure in the manner described above (that
is, by e-mail or telephone); no other form of
noticewillbeeffectivetooptoutofthisdispute
resolution procedure. Opting out of this dispute
resolutionprocedurewillnotaffectthecoverage
oftheLimitedWarrantyinanyway,andyouwill
continuetoenjoythefullbenefitsoftheLimited
Warranty.Ifyoukeepthisproductanddonotopt
out,thenyouacceptalltermsandconditionsofthe
arbitrationprovisiondescribedabove.
