If the Program is export ed from t he United States purs uant to t he License Exception TSR under
the U.S. Export Admi nistrat ion Regulat ions, in addition t o the restrict ion on transfer set fort h in
Sect ions 1 or 2 of thi s Agreement, You agree not to (i) reexport or release the Program, the source
code for the Program or technol ogy t o a nat ional of a country i n Country Groups D:1 or E:2 (Al bania,
Armenia, Azerbaijan, Belarus, Bulgaria, Cambodia, Cuba, Est onia, Georgi a, Iraq, Kazakhst an,
Kyrgyzst an, Laos, Latvi a, Libya, Lithuania, Mol dova, Nort h Korea, the People’s Republic of China,
Romania, Russia, Rwanda, Tajiki stan, Turkmeni stan, Ukrai ne, Uzbekist an, Vi etnam, or such other
count ries as may be des ignat ed by the Uni ted States Government), (ii) export to Count ry Groups D:1
or E: 2 (as defined herei n) t he direct product of t he Program or t he technol ogy, if such forei gn
produced di rect product is s ubject to national security controls as identified on t he U.S. Commerce
Control List , or (iii ) if the direct product of the technol ogy i s a complete plant o r any major
com ponent of a pl ant, export to Count ry Groups D:1 or E: 2 the direct product of the pl ant or a maj or
com ponent t hereof, if such forei gn produced di rect product is subj ect to national security controls as
identifi ed on the U.S. Commerce Control List or is subject to St ate Department cont rols under the
U.S. Munit ions List.
5. UNITED STATES GOVERNMENT RESTRICTED RIG HTS. The enclos ed Product (i)
was devel oped solely at privat e expense; (ii) cont ains “rest ricted com puter software” submi tted wi th
restricted right s in accordance with sect ion 52.227-19 (a) through (d) of the Comm erci al Computer
Software-Restricted Rights Clause and its s uccessors, and (i ii) in al l respect s is propri etary data
bel onging to Cablet ron and/ or its suppliers . For Department of Defense uni ts, t he Product is consi dered
com mercial computer software in accordance wit h DFARS section 227.7202-3 and it s successors, and
use, dupl ication, or disclosure by t he Government is subject to restrict ions set forth herein.
6. EXCLUSIO N O F WARRANTY. Except as may be specifically provided by Cablet ron i n
writ ing, Cabletron m akes no warranty, expressed or i mplied, concerning t he Program (i ncludi ng its
docum entation and media).
CABLETRON DISCLAIMS ALL WARRANTIES, OTHER THAN THOSE SUPPLIED TO
YOU BY CABLETRON IN WRITING, EITHER EXPRESS OR IMPLIED, INCLUDING BUT
NOT LIM ITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE, WITH RESPECT TO THE PROGRAM, THE ACCOMPANYING
WRITTEN MATERIALS, AND ANY ACCOMPANYING HARDWARE.
7. NO LIABILITY FOR CONSEQ UENTIAL DAMAGES. IN NO EVENT SHALL
CABLETRON OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER
(INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, PROFITS,
BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, SPECIAL, INCIDENTAL,
CONSEQUENTIAL, OR RELIANCE DAMAGES, OR OTHER LOSS) ARISING OUT OF THE
USE OR INABILITY TO USE THIS CABLETRON PRODUCT, EVEN IF CABLETRON HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOM E STATES DO
NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
INCIDENTAL DAMAGES, OR IN THE DURATION OR LIMITATION OF IMPLIED
WARRANTIES IN SOME INSTANCES, THE ABOVE LIMITATION AND EXCLUSIONS MAY
NOT APPLY TO YOU.
