14.0 LIMITED WARRANTIES BY THE SELLER
Provided that the Original User Buyer at all times remains in compliance with the Terms and
Conditions of purchase from seller including without limitation, at all times properly
maintains and uses the Equipment
(OTHER THAN THE EXCLUDED PARTS
DESCRIBED BELOW) will be free from defects in material and workmanship. The Buyer
affirms that it has selected the Equipment based on its own evaluation of its needs.
THE
BUYER'S SOLE AND EXCLUSIVE REMEDY, AND SELLER'S AND IT'S AGENTS
ONLY OBLIGATION, FOR ANY BREACH OF THE FOREGOING WARRANTY
SHALL BE TO REPAIR OR REPLACE THE EQUIPMENT INVOLVED (AT THE
SELLERS'S OPTION), OR, IF REPAIR OR REPLACEMENT IS IN SELLER'S
JUDGEMENT NOT PRACTICABLE, TO REFUND TO THE BUYER THE PURCHASE
PRICE PAID TO SELLER FOR THE SUCH DEFECTIVE EQUIPMENT.
THE EXCLUDED PARTS ARE: ALL INTERIOR AND EXTERIOR FINIS-
HES, VACUUM AND ABRASIVE HOSE ASSEMBLIES, MALE OR FEMALE
CONNECTIONS, BLAST HEADS, BRUSHES, NOZZLES OR AIRJETS, ABRASIVE
FEED PIPE AND OTHER PARTS WHICH HAVE ABRASIVE WEAR. ALL
EXCLUDED PARTS ARE RAPID WEARING AND ARE PROVIDED ON AN AS-IS
BASIS, WITHOUT WARRANTY OF ANY KIND.
All claims under the Seller's warranties must be made in writing with in one year of delivery
to the sales distributor/representative, if any, through whom the Buyer ordered the
Equipment (the "Sales Distributor/Representative"), with a copy to Seller. No repairs or
replacements shall be made under warranty other than by Seller’s or authorised Sales
Distributor's/Representative's personnel or the personnel of another contractor approved in
writing for such purpose by Seller.
THE SELLER'S WARRANTY SHALL NOT APPLY
if
the Equipment has been misused, altered, subjected to overloading, neglect, unusual wear,
accident, fire, flood or act of God, or used for any purpose or in any manner not
recommended in Seller's written instructions, including without limitation the use of any
unauthorized abrasives and any attempts at repair by the Buyer or any other person not
authorised by the Seller.
THE BUYER SHALL BE RESPONSIBLE FOR THE SELECTION AND USE OF THE
EQUIPMENT IN ACCORDANCE WITH ALL APPLICABLE FEDE-RAL, STATE,
LOCAL AND FOREIGN LAWS, INCLUDING WITHOUT LIMITATION
OCCUPATIONAL HEALTH AND SAFETY ENVIRONMENTAL AND OTHER LAWS
AND REGULATIONS, AND SELLER MAKES NO REPRESENTATION OR
WARRANTY WITH RESPECT TO THE EQUIPMENT COMPLIANCE WITH ANY
SUCH LAW OR REGULATION IN THE BUYER'S USES OR APPLICATIONS.
THE WARRANTIES STATED ABOVE ARE THE ONLY WARRANTIES MADE BY
SELLER, AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED,
OR ARISING BY LAW, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANT
ABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE
EXPRESSLY DISCLAIMED.
IN NO EVENT SHALL THE SELLER OR ANY OF ITS AGENTS BE LIABLE FOR
