IMPORTANT: READ BEFORE OPENING OR INSTALLING THE SOFTWARE
3Com® HomeConnect Networking Product
with Microsoft® HomeClick Network Software
IMPORTANT-READ CAREFULLY: This End-User License Agreement ("Agreement") is a legal agree-
ment between you (either an individual or a single entity) and 3Com Corporation ("3Com") for the
3Com HomeConnect Networking Product, which includes the accompanying Microsoft
HomeClick Network computer software, other 3Com software, and may include associated media,
printed materials and any "online" or electronic documentation ("SOFTWARE"). Use of other
Microsoft Corporation ("Microsoft") software which is bundled with the 3Com HomeConnect Net-
working Product which is licensed under a separate license agreement from Microsoft (either in the
form of a separate written agreement or in the form of a "click wrap" license) shall be governed
under the terms of such separate license agreement. By installing, copying or otherwise using the
SOFTWARE, you agree to be bound by the terms of this Agreement. If you do not agree to the terms
of this Agreement, 3Com and Microsoft are unwilling to license the SOFTWARE to you. In such
event, you may not install, use or copy the SOFTWARE, and you should promptly return the entire
3Com HomeConnect Networking Product (which includes all other software, hardware, and any
other materials that were included in the package), unused, to the supplier where you obtained it,
for a refund.
The SOFTWARE is protected by copyright laws and international copyright treaties, as well as other
intellectual property laws and treaties. The SOFTWARE is licensed, not sold.
GRANT OF LICENSE. This Agreement grants you the following rights:
Software Installation and Use. You may install and use the SOFTWARE on all computers that are
connected to each other via a peer-to-peer Local Area Network ("LAN") in the same building. This
includes installation and use of the SOFTWARE on a laptop that can be connected to any number of
such LANs.
You may permit computers within the LAN to connect to a single computer running the SOFTWARE
solely to access the Internet using the Internet Connection Sharing feature of the SOFTWARE.
You may not allow these connected computers to invoke application sharing except as described
below, however, any number of connected computers (as described above) may access or other-
wise utilize the file and printing services and peer web services. of the SOFTWARE. Each copy of
the SOFTWARE must contain 3Com's and its licensors' proprietary rights and copyright notices in
the same form as on the original. You agree not to remove or deface any portion of any legend
provided on any licensed program or documentation delivered to you under this Agreement.
DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
Limitations on Reverse Engineering, Decompilation and Disassembly. You may not reverse engi-
neer, decompile, or disassemble the SOFTWARE, except and only to the extent that such activity is
expressly permitted by applicable law notwithstanding this limitation. If you are a European Com-
munity ("EC") resident, information necessary to achieve interoperability of the SOFTWARE with
other programs within the meaning of the EC Directive on the Legal Protection of Computer Pro-
grams is available to you from 3Com upon written request.
Separation of Components. The SOFTWARE is licensed as a single product. Its component parts
may not be separated for use on more than one computer.
Rental. You may not rent or lease or lend the SOFTWARE.
Application Sharing. The SOFTWARE may contain functionality that enables applications to be
shared between two or more computers, even if an application is installed on only one of the com-
puters. You may use this technology with all Microsoft applications products for multi-party con-
ferences. For non-Microsoft applications, you should read the license agreement that came with
the application or contact the licensor to determine whether application sharing is permitted by
the licensor.
UNAUTHORIZED ATTEMPTS TO OPEN, REPAIR OR MODIFY THE PRODUCT, OR ANY OTHER CAUSE BEYOND
THE RANGE OF THE INTENDED USE, OR BY ACCIDENT, FIRE, LIGHTNING, POWER CUTS OR OUTAGES,
OTHER HAZARDS, OR ACTS OF GOD.
LIMITATION OF LIABILITY.
TO THE FULL EXTENT ALLOWED BY LAW, 3COM ALSO EXCLUDES FOR ITSELF,
MICROSOFT AND ITS SUPPLIERS ANY LIABILITY, WHETHER BASED IN CONTRACT OR TORT (INCLUDING
NEGLIGENCE), FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY
KIND, OR FOR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, OR
OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE SALE, INSTALLATION, MAINTE-
NANCE, USE, PERFORMANCE, FAILURE, OR INTERRUPTION OF ITS PRODUCTS OR ANY SEPARATELY LI-
CENSED THIRD PARTY SOFTWARE PACKAGED WITH THE PRODUCTS, EVEN IF 3COM OR ITS AUTHORIZED
RESELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND LIMITS ITS LIABILITY TO
REPAIR, REPLACEMENT, OR REFUND OF THE PURCHASE PRICE PAID, AT 3COM'S OPTION. THIS DIS-
CLAIMER OF LIABILITY FOR DAMAGES WILL NOT BE AFFECTED IF ANY REMEDY PROVIDED HEREIN SHALL
FAIL OF ITS ESSENTIAL PURPOSE.
DISCLAIMER:
Some countries, states, or provinces do not allow the exclusion or limitation of implied
warranties or the limitation of incidental or consequential damages for certain products supplied to
consumers, or the limitation of liability for personal injury, so the above limitations and exclusions may
be limited in their application to you. When the implied warranties are not allowed to be excluded in their
entirety, they will be limited to the duration of the applicable written warranty. This warranty gives you
specific legal rights which may vary depending on local law.
GOVERNING LAW:
This Limited Warranty shall be governed by the laws of the State of California, U.S.A.
excluding its conflicts of laws principles and excluding the United Nations Convention on Contracts for the
International Sale of Goods.
