Appendix A: Terms & Conditions
BY USING THE SILVAIR LIGHTING EVALUATION KIT YOU ACCEPT THESE TERMS AND
CONDITIONS (I.E. YOU AGREE THAT THE USE OF THE SILVAIR LIGHTING EVALUATION
KIT CONSTITUTES ACCEPTANCE OF THE TERMS AND CONDITIONS FROM THAT POINT
ONWARDS).
IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS, THEN DO NOT
DOWNLOAD, INSTALL, COMPLETE INSTALLATION OF, OR IN ANY OTHER WAY MAKE
USE OF THE SILVAIR LIGHTING EVALUATION KIT OR RELATED CONTENT.
This Terms and Conditions (hereinafter: the “Agreement”) apply to the Silvair Lighting
Evaluation Kit and associated documentation delivered to you and your Company (the “User”)
by Silvair, Inc. a Delaware corporation having its principal place of business at 717 Market
Street, Suite 100, San Francisco, CA 94103 USA acting on behalf of itself and its affiliates,
(collectively “Silvair”). The Silvair Lighting Evaluation Kit shall be understood as any portion of
the whole (i.e. the hardware products contained in the Silvair Lighting Evaluation Kit and/or any
software provided with the Silvair Lighting Evaluation Kit).
1. Permitted Uses.
Subject to the Agreement and during the term of this Agreement, the
User may use the Silvair Lighting Evaluation Kit (including its software) for the purpose
of professional ENGINEERING, DEVELOPMENT, DEMONSTRATION, TESTING OR
EVALUATION PURPOSES CONCERNING USABILITY OF THE USER’S PRODUCTS
WITH SILVAIR TECHNOLOGY ONLY (the”Purpose”). Users handling the Silvair
Lighting Evaluation Kit must have electronics training and observe good engineering
practice standards.
2. Prohibited Uses.
The User shall not, and shall not permit others to:

use the Silvair Lighting Evaluation Kit contrary to applicable law or any purpose other
than for the Purpose set forth in Subsection (A) above and/or for any purpose
inconsistent with any applicable law, rule, or regulation;

port, disassemble, decompile, reproduce, in whole or in part, the Silvair Lighting
Evaluation Kit; translate, reverse engineer, disassemble or otherwise attempt:
— to defeat, avoid, bypass, remove, deactivate or otherwise circumvent any software
protection mechanisms in the Silvair Lighting Evaluation Kit or components thereof,
including without limitation any such mechanism used to restrict or control the
functionality of the Silvair Lighting Evaluation Kit, or
— to derive the source code or the underlying ideas, algorithms, structure or
organization from the Silvair Lighting Evaluation Kit or components thereof;
