Termination clause:
The supply contract shall be terminated automatically in accordance with art. 1456, with a simple
declaration written by the supplier that he wishes to avail himself of this express termination clause if the customer: omits or
delays payments due; delays or fails to take delivery of the products in the times agreed upon; does not observe the obligations
of confidentiality.
The contract shall be deemed terminated automatically if the customer is wound up or is subjected to any bankruptcy
proceedings.
Withdrawal by agreement:
If the customer reduces the guarantees that he had given or does not provide the
guarantees he had promised, the supplier shall have the authority to withdraw from the contract without the need of prior
notification.
Applicable law:
All supply contracts regulated by these general conditions shall be governed by
Italian law
.
Competent court:
The
court of Brescia
in Italy
shall be the only competent court for any disputes relating to the
execution, interpretation, validity, cancellation or termination of supply contracts entered into between the parties.
STATEMENT OF ACCEPTANCE OF THE MACHINE
1. We confirm that the machine has been delivered to you in order and, if present, with The
movable protection installed.
2. we confirm that the machine has been delivered to you in order and, if present, with the
movable protection and respective safety device installed and in order.
3. We confirm that the machine has been delivered to you in order and, if present, With the
fixed protection installed.
4. We confirm that the machine has been delivered to you in order and, if present,with the
fixed protection and respective safety device installed and in order.
5. We confirm that the machine has been delivered to you in order and, if present, with
the emergency switch placed on the electric panel installed and in order.
6. We confirm that the machine has been delivered to you in order and, if present, with the
main switch placed on the electric panel installed and in order.
7. We confirm that the machine has been delivered to you together with the use and
maintenance manual which the person in charge will have to read, understand and have
a thorough knowledge of before operating.
8. In particular we have informed you about the existence of residual risks implied in The
use of the machine, so as it is specified in the use and maintenance manual.
IF, FOR ANY REASON, THE MACHINE DOESN’T HAVE THE QUALIFICATIONS ABOVE
MENTIONED FROM POINT 1 TO 8 AND IN PARTICULAR ONE HASN’T GOT KNOWLEDGE OF
