Products sold by PalmSens BV are not designed, intended or approved for use in life support,
implantable medical devices, transportation, nuclear, safety or other equipment where
malfunction of the Product can reasonably be expected to result in personal injury, death, severe
property damage or severe environmental harm. Buyer represents and warrants that it will use
appropriate safeguards to minimize potentially dangerous consequences associated with
Product failure. Notwithstanding the foregoing, if Buyer uses or sells Products for in such critical
applications, it does so at Buyer’s own risk and Buyer agrees to defend, indemnify and hold
