in force in the country where the product is
installed or used;
Conditions or defects in the systems to which
the product is connected or into which it is
incorporated;
Repairs or attempts to repair the product by
unauthorised personnel;
Adaptations or modifications made to the
product without prior written authorisation from
the manufacturer, updates to the product
exceeding the specifications and functions
described in the instruction manual, or
changes made to the product to make it
compliant with national or local technical or
safety regulations in countries other than the
ones for which the product was specifically
designed and manufactured;
Negligence
Accidental events, fires, liquids, chemical
substances or substances of another nature,
flooding,vibrations,
excessive
heat,
inadequate ventilation, surges in current,
excessive or incorrect input supply voltage,
radiations, electrostatic charges, including
lightning, other forces and external impact.
11.3
Exclusions and limitations
Notwithstanding what is stated above, the
MANUFACTURER does not issue any product
guarantee (explicit, implicit, statutory or of any
other nature) regarding quality, performance,
accuracy, reliability or suitability for a particular use
or similar.
Should this exclusion not be permitted fully or in
part by the applicable law, the MANUFACTURER
excludes or limits its own guarantees to the
maximum limit permitted by the applicable law.
Any guarantee that cannot be completely
excluded shall be limited (within the terms
permitted by the applicable law) to the duration
of this warranty.
The MANUFACTURER’S only obligation in the
context of this warranty consists in repairing or
replacing products in accordance with the terms
and
conditions
of
this
warranty.
The
MANUFACTURER declines all responsibility for loss or
damage in relation to the product, services, this
warranty or similar, including economic or
intangible losses – the price paid for the product –
loss of profits, income, data, enjoyment or use of
the product or of other associated products –
indirect, incidental or consequential losses or
damage. This is applicable for losses or damage
deriving from:
Impairment in the operation of or failure of the
product or associated products as a result of
defects or lack of availability while at the
MANUFACTURER’S site or at another authorised
service centre, leading to stop time, loss of
useful time or interruptions to the workflow
Imperfect performance of the products or
associated products.
This is applicable for losses and damage within the
framework of any legal theory, including
negligence and other unlawful acts, breaches of
contract, explicit or implicit guarantees and strict
liability
(including
in
cases
where
the
MANUFACTURER or authorised service centre have
been informed regarding the possibility of such
damages).
Where the applicable law prohibits or limits these
exclusions of liability, the MANUFACTURER excludes
or limits its liability to the maximum extent
permitted by the applicable law. Some countries,
for example, prohibit the exclusion or limitation of
damages due to negligence, gross negligence,
intentional non-compliance, fraud and other
similar acts. The MANUFACTURER’S liability in the
context of this warranty shall not, in any case,
exceed the price paid for the product,
notwithstanding that, where the applicable law
imposes higher limits of liability, such limits shall be
applied.
11.4
Reserved legal rights
Applicable national laws grant buyers (statutory)
legal rights relative to the sale of consumer
products. This warranty does not prejudice the
rights of the buyer established by the laws in force,
the rights that cannot be excluded or limited, or
the rights of the customer with regard to the
retailer. The customer may decide to take avail of
their rights at their own exclusive discretion.
