1.  For the purposes hereof:
 

a) „Producer" shall mean HABYS Sp. z o.o. located in Jasło, Poland, at 16 Produkcyjna Street. 

 

 

b) „Purchaser" shall mean the final Purchaser of the equipment manufactured by the Producer.

 

c) „Authorised Service" shall mean the service maintained by the Producer. 

2.  The Producer shall ensure good quality and operation of the equipment for which the guarantee card has  
 

been issued for the period: frame 5 years, upholstery 2 years, electrical and hydrualical components 2  

 

years.

3.  Guaranteed repair shall not cover activities provided for in the instruction manual which should be  
 

performed by the Purchaser themself.

4.  The guarantee shall not cover: damages to the equipment resulting from inappropriate usage or usage  
 

incompliant with the instruction manual, maintenance instructions, transportation instructions or  

 

additionally, any mechanical  damages; colour differences between the parts exposed and not exposed to  

 

sunlight; impact of chemicals or abrasive agents, atmospheric pollution and accidental puncture, the  

 

presence of spots or rings on the oily or colouring substances (fats, creams, lotions or oils); permanent  

 

staining of some colouring agents, such as: ink, permanent markers or other non-colorfast dyes used in the 

 

production of clothing (for example: blue jeans).

5.  The Purchaser shall lose their guarantee rights if:
 

the Producer discovers that during the guarantee period, the equipment was repaired outside the  

 

a) 

 

authorised service; 

 

b) any design modifications were introduced thereto without the Producer's consent; 

 

c) the equipment was still used following the disclosure of a constructional defect.

.  In cases provided for in point  , irrespective of the loss of guarantee rights, HABYS Sp. z o.o. shall not be  

 

responsible for any damage to property or person which might be caused by operation of such equipment.

7.  Defects or damages to the structure of the equipment resulting from the equipment itself, disclosed during 
 

the guarantee period, shall be removed free of charge within 14 days from the date of delivery the  

 

equipment to the Producer or authorised service.

8.  Provided that within the 30 days referred to above, repairs cannot be done, the manufacturer shall  
 

immediately inform the Customer about it, specifying the reasons for the delay and the expected date

 

of executing accepted complaint, which should be done as soon as possible.

9.   The guarantee shall not exclude or limit any rights resulting from non-conformity.
10.  In order to enjoy guarantee rights, it shall be necessary to fulfill the following conditions jointly:
 

a) production of an invoice or other proof of equipment purchase by the Purchaser; 

 

b) report the complaint 14 days after the defect of the product is discovered;

 

c) send back the damaged equipment in an original packaging.

11.  The guarantee period shall be extended by the guarantee repair time, counted from the date of delivering 
 

the equipment to the Producer or authorised service to the day on which the equipment is made available 

 

to the Purchaser to recover.

12.  Identification of the manner and necessary scope of the repair shall be the responsibility of the Producer
 

or authorised service.

13.  The guarantee shall be limited to repair or, in the second instance, to replacement. The manufacturer shall 
 

not  accept any liability for indirect loss or damage.

1 .   The Producer shall not undertake responsibility for damages to the equipment aroused during

transportation by a forwarding company. It is the Purchaser's obligation to inspect the technical condition 
of the equipment upon the reception thereof.

1 .  If transportation was commissioned by the Producer and the goods have been damaged, the Purchaser is

obligated  to:

 

a) let the Producer know in 3 day time from the date of delivery about any damages of equipment, which 

happened during transportation in order to enable the Producer to file a complaint with the forwarding 
company;

 

b) provide the Producer protocol of complaint which is written between the Purchaser and transportation 

company. 

1 .  Terms of guarantee contained herein shall be the sole and original terms of guarantee for HABYS Sp. z o.o.
