The after sale assistance service under warranty is directly supplied by GEL in cooperation with the dealers.
Compensation requests for damages to persons, objects or property which may be due to a defective
product must be addressed to GEL directly, specifying the damage that has occurred, the date when it has
occurred, the defect encountered in the product, the date of purchase.
In accordance with the European Directives 85/374/EC and 99/34/EC, the burden of proof rests with the
claimant. GEL will take such compensation requests into account only if supported by appropriate technical
assessments. The injured person shall be required to prove:
- the existence of the damage;
- the defect of the product;
- the causal relationship between defect and damage.
GEL shall not be liable for the damage if they prove:
- that they did not put the product into circulation;
- that the product was neither manufactured or distributed by them in the course of their business;
- that the state of technical knowledge at the time when they put the product into circulation was not such
as to enable the existence of the defect to be discovered;
- that the defect which caused the damage did not exist at the time when the product was put into
circulation;
- that the product was neither manufactured by them for sale or any form of distribution for economic
purpose;
- that the defect is due to compliance of the product with mandatory regulations issued by the public
authorities.
