13. Livestock transport regulations
In Germany, the commercial transport of livestock is governed, among other things,
by the EU Regulation (EC) 1/2005, the national law on animal protection during
transport (TierSchTrV) and the livestock transport regulation (VVVO).
In this context, farmers are granted special status, though this is subject to various
conditions. The controlling and prosecuting authority for infringement of animal
welfare and epizootic disease regulations is the relevant local veterinary office.
The police provides administrative assistance to this office in the form of roadside
checks.
13.1 Livestock transport requirements
It is prohibited to conduct or arrange the transport of livestock if there is the possibility of animals
being injured or subjected to unnecessary suffering during this transport.
The animals should be transported to the intended destination without delay.
The welfare of the animals must be checked on a regular basis and maintained by suitable means.
All livestock transport vehicles must be driven in an appropriate, anticipatory manner that minimises
the risk of injury.
Before commencing transport, all necessary steps must be taken to attend to the needs of the
animals during transport.
There must be no unnecessary delays between the completion of the loading process and
departure of the transport vehicle.
13.2 Agricultural livestock transport up to 50 km
The EU transport directive applies to the transport of animals in the context of commercial activity.
Farmers are thus considered
commercial transporters
. However, when transporting their own animals
with their own vehicles up to a distance of 50 km, they merely have to comply with the general
conditions of transport as per Article 3 of Regulation (EC) No. 1/2005.
The general conditions of transport stipulate the following:
The transport duration must be as short as possible
The welfare of the animals must be checked on a regular basis
The animals must be suitable for transport (no injured animals, no animals with physical
weaknesses or pathological conditions, special regulations regarding minimum age and
gestation may also apply)
The means of transport as well as the loading and unloading equipment must be safe and must
not cause any suffering or injury to the animals
The transport personnel must be suitably qualified and possess the necessary expertise; no use
of force, no injury to or suffering on the part of the animals (in the case of agricultural transports
up to 50 km, the personnel merely requires the relevant expertise, e.g. agricultural training; no
additional proof is necessary)
Sufficient floor space and standing height
When farmers transport not just their own animals or the transport distance
exceeds 50 km, the stipulations of the entire animal transport directive apply.
This requires detailed information on the livestock transport as well as
corresponding permits and documentation; see section 13.3.
