Further claims cannot be asserted. Liability for consequential
damages is ruled out. Moreover, we are not liable for losses,
damage or delays caused due to force majeure, gross negligence
or due to reasons that are beyond our control.
5. The agreement shall come into effect on
and be valid for
year(s) and shall be automatically
extended by one year if it is not terminated in writing by any of
the contractual partners three months prior to the end of the
tenure.
6. The contractual price is

statutory sales tax for each maintenance activity and is immedi-
ately payable in cash on receiving the invoice.
7. The contractual price is based on costs as on
(date).
If costs change after this date, we are entitled to change the
contractual price accordingly after prior agreement. This is also
applicable to any change in the statutory sales tax.
8. Statutory regulations by the court of law shall be definitive for
all legal disputes arising from this agreement.

2. With this agreement,
the company:
undertakes to provide the following services:
2.1
Minor maintenance, at an interval of
months during working hours on weekdays.
• Lubricating all moving parts and bearing points,
• Cleaning the unit.
2.2
Major maintenance, at an interval of
months during working hours on weekdays.
• As 2.1 plus additional technical inspection.
3. The scope of supply of this agreement does not include the
following services:
3.1
Free-of-charge rectification of operational defects
between the maintenance intervals.
3.2
Free-of-charge repairs and delivery of spare parts.
4. This agreement does not affect the rights and obligations of the
owner as regards the operation of the awning unit.
Being the contractual partner of the awning unit operator, we
are liable only for such damages which can be attributed to
the culpable violation of our contractual duties. Our liability is
restricted to the scope of our operational third-party liability
insurance for personal, material and financial losses covered by
the insurance:
