deemed to have failed of its essential purpose so long as USF is willing and able to
repair or replace any nonconforming USF system or component part thereof. USF
shall not be liable for consequential damages resulting from economic loss or
property damages sustained by any customer from the use of its process systems.
Products or components manufactured by companies other than USF or its affiliates
(“Non-USF Products”) are covered by the Warranty, if any, extended by the Product
manufacturer. USF hereby assigns to the purchaser any such warranty: however,
USF EXPRESSLY DISCLAIMS ANY WARRANTY, WHETHER EXPRESSED OR
IMPLIED, THAT THE NON-USF PRODUCTS ARE MERCHANTABLE OR FIT FOR
A PARTICULAR PURPOSE.
