Signalement d’un possible Défaut de Fabrication d’une
composante
4. Le client doit signaler impérativement et promptement par
écrit au détaillant qui lui a vendu la piscine (ci-après désigné le «
Détaillant ») toute anomalie ou particularité d’une composante
qui pourrait indiquer un possible Défaut de Fabrication, et lui
fournir le contrat d’achat et une description détaillée, avec
photographies à l’appui, de l’anomalie ou particularité constatée.
Tel signalement doit parvenir au Détaillant au plus tard deux
semaines après la première apparition de l’anomalie ou
particularité. Tout retard dans le signalement aura pour effet
d’annuler la garantie ou d’en réduire l’application.
Sur réception du contrat d’achat, de la description détaillée et
des photos, le Détaillant fera une analyse appropriée du
signalement reçu et informera le client si la composante en
question présente ou non un Défaut de Fabrication et, s’il y a lieu,
l’informera aussi de la réparation qui doit être effectuée pour
corriger ledit Défaut de Fabrication. Dans l’éventualité où le client
ne pourrait lui-même fournir une description détaillée de
l’anomalie ou particularité avec photographies à l’appui, le client
peut demander l’intervention du technicien du Détaillant et, dans
ce cas, des frais de déplacement seront facturés au client.

5. Lorsque l’analyse de la situation dont il est fait état à la section
no 4 conclut qu’une réparation pour corriger un Défaut de
Fabrication d’une composante doit être effectuée, et lorsque
telle réparation est entreprise au cours des deux premières
années de la garantie, telle réparation à la composante ayant
un Défaut de Fabrication, et seulement la réparation à cette
composante, sera entièrement à la charge de Taïga Zone. Les
frais d’expédition sont entièrement à la charge du client.

6. Lorsque l’analyse de la situation dont il est fait état à la section
no 4 conclut qu’une réparation pour corriger un Défaut de
Fabrication d’une composante doit être effectuée, et lorsque
telle réparation est entreprise entre le début de la 3e année de la
garantie et la fin de la dernière année de la garantie, le coût de
la main-d’œuvre et les frais d’expédition seront entièrement à la
charge du client, tandis que le coût des matériaux sera réparti au
pro-rata entre Taïga Zone et le client de la manière prévue à la
section no 9. Taïga Zone remettra au client un devis de coûts
indiquant les coûts de la main-d’œuvre et du matériel requis pour
effectuer la réparation du Défaut de Fabrication dont il est fait
état dans cette section. La section no 8 fait état des paiements
exigés du client lorsqu’il a à sa charge la totalité ou une partie
des coûts de main-d’œuvre et des coûts de matériel.
Travaux autres que ceux exigés par la réparation d’un Défaut de
Fabrication d’une composante
7. Advenant que la réparation d’un Défaut de Fabrication à une
composante, réparation dont il est fait état aux sections no 5 et
no 6, exige le déplacement, la modification et la réparation de
constructions, de terrassement, d’aménagement paysager, de
composantes autres que celles présentant un Défaut de
Fabrication, d’appareils, ou autres dispositifs, le coût de tel¬¬
déplacements, modification et réparation sera entièrement à la
charge du client. Sur demande du client, Taïga Zone dressera un
devis du coût de tels déplacement, modification et réparation. La
section no 8 fait état des paiements exigés du client lorsqu’il a à
sa charge le coût de tels déplacement, modification et réparation.
notification of Possible Manufacturing defects in a Part
4. it is imperative that the Customer notify the retailer
who sold the pool (hereinafter referred to as the
“retailer”) promptly and in writing of any anomalies or
peculiarities the Parts may exhibit that could indicate
possible Manufacturing defects, and provide him with
the purchase receipt as well as a detailed description
and supporting photos of the anomaly or peculiarity
observed. The retailer must receive this notification no
later than two weeks after the first appearance of the
anomaly or particularity. Any delays in notification will
void the warranty or reduce its scope.
upon reception of the purchase receipt, detailed
description and photos of the problem, the retailer will
appropriately review the situation and inform the
Customer whether the Parts show Manufacturing
defects and, if applicable, will inform the Customer of
repairs required on the Parts to correct said
Manufacturing defects. if the Customer is unable to
provide a detailed description of the anomaly or
particularity with supporting photos, the Customer may
request the assistance of the retailer technician. in this
case, travel costs will be billed to the Customer.
repairing Manufacturing defects in Parts during the
First Two years of the Warranty Period
5. if a review of the situation as described in Section 4
concludes that repairs are required to correct
Manufacturing defects in Parts, and if such repairs are
carried out in the first two years of the warranty period,
the cost of these repairs to the Parts, and only repairs
to the Parts, shall be assumed by Taïga Zone. All freight
charges shall be assumed by the Customer.
repair of Manufacturing defects in Parts Between the
Start of the Third year and the end of the Last year of the
Warranty Period
6. if a review of the situation as described in Section 4
concludes that repairs to correct the Manufacturing
defects of Parts are required, and if such repairs are
carried out between the start of the third year and the
end of the last year of the warranty period, the Customer
shall assume all labour and freight costs, while the
material costs shall be divided between Taïga Zone
and the Customer on a prorated basis as described in
Section 9 of this document. Taïga Zone shall submit to
the Customer a cost estimate for materials and labour
needed to repair the Manufacturing defects in Parts
described in this section. Section 8 describes the
payments to be assumed by the Customer when liable
for all or a share of labour costs and material costs.
Work Other than that required by the repair of a
Manufacturing defect in a Part
7. in the event that the repair of a Manufacturing
defect in a Part, as detailed in Sections 5 and 6,
requires travel, the modification and repair of structures,
earthwork, landscaping, Parts other than those
presenting a Manufacturing defect, equipment or other
devices, the cost of such travel, modifications and
repairs shall be assumed entirely by the Customer.
upon request of the Customer, Taïga Zone will prepare
a cost estimate for such travel, modifications and
repairs. Section 8 details the payments required when
the Customer is called on to assume the costs of such
travel, modifications and repairs.
